Over a year ago I signed up for credit card processing and payment plan processing with Jeff Gates of DMS.  I was quoted a set of rates for my processing and prices for new PCI compliant terminals that would process the new chip embedded credit cards.  From day one the rates were higher than promised and there were many add on fees that were not disclosed in the sales process.  Furthermore, the terminals they sold me were obsolete and will not read the chips in the new credit cards.  I worked with Jeff for over a year, at one point he even promised me he would pay my cancellation fees if I was not happy.  As time went along and nothing got resolved Jeff became less and less responsive to my calls and emails.  As it sits now, I have cancelled my service with EVO, the processor they set me up with and in addition to the $1000 I paid for the terminals I will be out another $750 for cancelling the contract.  I have had no response to any form of communication from DMS in over 6 months.  Even emails from EVO have gone unanswered.  And by the way, they are not a direct processor like the claim to be, DMS is just a broker who will take a cut of your credit card fees and cost you more money.

After filing my complaints with the Ripoff Report and the BBB, my case was promptly taken up and handled by DMS.  They were able to secure my uncoditional termination of processing services from EVO without penalty. They also agreed to buy back the terminals.  I have returned the terminals to DMS and am awaiting my refund check.

Satisfactory resolution for the merchant

The processing rates quoted to the merchant came directly from EVO, and we have no control over EVO charging more than what they quoted, including any add-on fees; nor were we ever informed of any such increases unless like in this case, the merchant told us.

In addition, we were told by EVO that the processing terminals we sold the merchant were, in fact, PCI compliant.  This, too, we subsequently found out from the merchant was not the case.  When we confronted EVO about the terminals as well as a higher rates being charged the merchant, EVO assured us that the terminals were PCI compliant, but their platform was not yet compatible with the terminals, but would soon be.  EVO also said that they would adjust the processing rates to what they quoted the merchant, neither of which ever came to pass, regardless of our constant requests for them to do so.  We, in fact, even had EVO agree to charge the merchant a lower processing rate than what they quoted to compensate the merchant for the time period they charged him higher rates, which, of course, never happened either.

Nonetheless, we recently made an agreement with the merchant to buy back the terminals for the amount he paid, as well as cover any contract cancellation fees on his behalf, thereby satisfactorily resolving the issue with the merchant.

EVO used to be a reliable righteous processing company; however, ever since they changed ownership a year or so ago we have run into similar practices with other merchants much the same as what happened in this case and, therefore, we no longer do business with EVO.

We sincerely apologize for any inconvenience that was caused to the merchant.
