Before graduating my school where the original loan took place, i was in a horrible vehicle accident leaving me unable to perform duties that i went to school for.
i realize that i took a loan out for school..but this man, Dave jones is calling me threatening that the government is filing a law suit against me, He claims that he has the phone number of where i work(although i havent worked in over a year!)
He says in two days they will be detaching my wages from this job ..(the business is no longer in service. It closed down in may of 2000). He insists that I'm lying about the job. mr. johns has contacted people in my neighborhood because of having the same street name and had these people come to my home. One was a strange man that came to my home after 8pm at night when i was alone with three children. He knew my full name and my address and also knew i was alone. He gave me the name dave johns and a phone number to "call my friend collect!!" I told the stranger that he was not an old friend of mine.
The last time a lady came to my home knowing my info, and told me that my old highschool friend was trying to contact me. Again, this was after hours. My mother, my brothers and my 87 year old grandmother have been harrassed my this man. He told them they all need to write a letter stating that they no longer want calls regarding me. Even the strangers ...can you believe this?
I dont deny owing a $5759.00 loan... but he is threating to sue me for $15423.88 for interest and other charges. For what - his charges for harrassing my famly and neighbors? Can anyone tell me what to do in a case like this? The schools are cooperating and are giving me any promisary notes signed and receipts of what they were given. This is very helpful but the harrassing calls must come to an end.
I was out of spinal surgery, unable to sit up, walk, use restroom, eat, bathe, etc. and he called over and over harrassing me. I can't take any more of this. It caused me at one point to feel suicidal... no lie. The depression caused by the harrassment and the surgerys and pain... i just dont know how long i can take this.

Please remember that DCS is merely a collection agency. The real debt holder is the US Department of Education. As a federal agency, the are subject to politial pressure. Try contacting your local Representative (should be in the blue pages of the phone book under Federal Gov't). Contact that individual's office and explain your problem. The loan won't go away, but they can probably get hte collection activity to back off until you are back on your feet.
The collection activity you described is a probable violtion of the Federal Debt Collection Practices Act, and if the harrassment continues contact the closes office of the FTC (Federal Trade Commission) and file a complaint.
