I use to work for George S May International which failed miserably but this one is Worse! Dolphin Pacific Group just entered Canada a few months ago and might I add that they didn't even have a business registration while working here. I had a car accident during work and had to go on a Leave Of Absence (LOA) unpaid. Just before my leave, I made a sale which ran while I was away. I was promised full commission but my pay period was changed several times. Today is pay day and nothing. After requesting my pay, they told me I don't get paid while on LOA so I quit. Now they say their contract allows them to pay me nothing...or so they say. There is a lengthy paragraph 7. that reads as follows:

7. In the event that the earnings referred to in Paragraph 3 and 4 above do not amount to five Hundred Dollars ($500.00) or more

Now this means that the following only pertains if owed less than $500 in which case I was owed $500 for two weeks base plus $550 commission for the Sale of Scrapbook Sally.

7. cont. in a regular biweekly period and the Employee is not on unpaid leave of Absence, the difference between actual earnings and the Five Hundred Dollars ($500.00 will be compensated to the Employee. In the event that that an Employee begins employment, terminates employment or is on unpaid leave of absence during any regular bi-weekly payroll period, he / she will be compensated on a prorated basis

Now this mean that if I quit in the middle of a pay period, I get a prorated amount of the $250 / week base salary based on the number of days working before the quit date.
Nowhere in your contract does it state that you can retain my commissions if I quit or that I am entitled to nothing if I quit.

Now clause 18 of their contract says the laws in our province provail. Which means I was due commissions within 10 days of the sale and that I am due the base amount.

Don't be dupped by the company. Each employee will tell you they own the company and they even said they are members of the Better Business Bureau, which they are not.
