Donna Roberts, Dog Breeder, Oregon Donna Marie Roberts Did not disclose dog was sick, altered the contract to attemptfraud to avoid honoring her contract Central Point, OR

Tori, a 4 lb Yorkie born 5/20/17. I bought her, 7 mos old 12/18/17, Tori was "odd". But new home, I wrote it off. Tori was a happy, playful pup, but very tiny, with poor appetite, vomiting, car sick. After paying $1500 and signing the contract, the breeder and Mr. X, who was with me, an I were handed a large syringe with red fluid. Breeder said "Give Bijou (as she called Tori) X amount until gone. I asked why? Breeder said " Im having trouble getting her to eat, all my dogs have bloody stools, from drinking out of mud puddles. It doesn't hurt them, just give her that until it's gone." Tori did not have bloody stools, I didn't give it to her. My vet threw it away, not knowing what it was or why it was needed. The breeder also opened Tori's mouth and said "I pulled their canines myself, i broke one off in Bijou's mouth. If it doesn't fall out, your vet can pull it." Tori fought the entire time the breeder was jerking her around. It did not fall out and I paid to have it surgically removed. Tori was spayed on 2/15/18. She also received 3 vaccines as the breeder self vaccinated and logged onto an index card. However, the card I received was not Tori's (Bijou). 

It belonged to a dog named Hannah that the breeder never offered or showed to me. The Vet was unclear what was received or if they had been given correctly. I paid for all new vaccinations. After surgery Tori was again "odd" but intensified. On 3/6/18 she had a major episode. She was terrified, tremors, head spinning, circling, rubbing her head on everything, running aimlessly into walls, loss of bladder, blindness, she didn't know me at all. Then she became lethargic. To the Vet we went. Possibly tooth pain or anxiety? She slept all the next day, slowly coming around, then it would happen again. From Mar 6 to May 31, we  'camped' at the Vets. She had episodes any time 2 days,10 days, no pattern. Many tests-many dollars, we got a diagnosis on May 31, 2018. A congenital/genetic disease, portosystemic Tori, a 4 lb Yorkie born 5/20/17. I wrote it off as she was different from my previous dog, new house, new owner, etc. But she would act like she was afraid she would be beat. She would hide, under the bed, under tables. She would shake/shiver. She did not come when called instead she would run away. After meeting the breeder, Donna Roberts, and viewed 2 puppies, Hailey & Bijou. I chose "Bijou", paying $1500 cash, per her request and signing the contract. Mr. X, who was with me, and I began to exit to leave. A Bile Acid Test was used for the results. The shunt caused Tori to have a secondary condition called hepatic encephalopathy, caused by severe liver damage due to lack of blood supply to it and toxins destroying her brain. Her "oddities" explained. Vomiting, diarrhea, constipation, lack of appetite, excessive appetite, craving unnatural stuff (wood steps & cat poop), increased urine, thirst, failing to thrive (loss of 1/2 lb) and her hair had become an unkempt matted mess almost over night, all symptoms. I begam emails to the breeder 5/14/18 before diagnosis. Asking if she has seizures in other dogs. No response.  i sent 3 messages thru 6/3/18. At that time, I went on Puppyfind.com. the breeder had 18 pups for sale of no less than 8 breeds and cross-breeds. One had the same picture I was shown when I began to purchase Tori. I wrote a poor review of the breeder, and sent her an email through Puppyfind, stating the picture of Daisy was Tori. I got her attention. Thru emails I tried to offer resolution. I was met with none addressing my suggestions but resistance, denial and threats.

The breeder stated she had seen this twice and the people were "nice and classy" and she replaced their dog. She offered another dog once, I asked about a clean health record with a Bile Acid Test, no further offer. She stated her Vet told her it was not genetic so she didn't need to worry about it.  She continues to breed and sell pups. In our last correspondence, she threatened "at no cost to sue me for slander", I stopped all contact. Puppyfind removed my review. I asked them why. I was told the breeder contested it, in order to reinstate Puppyfind asked for proof. I sent them pages of med records, the contract,  emails between the breeder and I. I hit a brick wall. Puppyfind stating I broke the contract,  nothing else mattered.  WHAT? I requested proof. They sent me a copy of the contract that Donna Roberts had submitted. SHE HAS ALTERED IT!  I immediately told Puppyfind to stop my review and not to share anything I has submitted with anybody. They agreed. The breeders on Puppgfind I have since learned are able to remove their own bad reviews.  When I felt I was being discrimated against by the person named Joanna at Puppyfind and asked for a supervisor and phone number. Joanna responded that "she is a supervisor and they don't take phone calls to help reduce costs".

All correspondence is by email." I have since found a phone number in the internet. However, due to my taking a different direction with this issue based on the fraudent contract submitted by the breeder I made no further contact. Puppyfind also had a copy of the contract I submitted to them but they ignored it and took the breeders copy as proof. On May 14, 2018 prior to any type of diagnosis I reached out to Ms. Roberts by fb messenger. And 2 additional times. She did not respond to these until June 8, 2018. After our direct email and her threats when I stopped corresponding on June 7, 2018. The response offered no resolution. She stated ahe just got them. Facebook Messenger work like a text. It's within seconds for delivery. I did not respond. On June 11, 2018 when I responded to Puppyfind.com email requesting proof with many documents including the contract, vet records, and emails between myself and the breeder. They responded that they would need a final diagnosis of a liver shunt.  I explained I cannot get that until I see the surgeon/specialist, but they had my regular vet records. Those were not good enough. They said it was required even though my vet medical.records.listed a shunt and treatment is being done for a shunt.

I am in need of $1000 for an consultation with a Veterinarian Surgeon, and an ultrasound that he will use to determine if my dog is a candidate for the surgery to attempt to correct her disease. This surgery begins at a price of $5000 barring no complications. There is also no guarentee. Ms Roberts alteration of the contract was to try to appear that a vet visit was required in 48 hours or the contract was void. Their is no clause of such on my copy. However, in her attempt to do this, she made an error. I purchased my dog on 12/18/2017. 2017. Ms. Roberts entered a date to see a vet within 48 hours as 12/20/2018. 2018. Actually giving me 1 year and 48 hours to see a vet. Beside the point, this genetic disease can appear anytime.  It usually will within a dogs first year of life, as it did it my dog. But it may take longer. The clause in my contract regarding genetic disease states if the dog is found to have, I must return the dog and she will replace it with one of equal value, if available. There is no date specified for this clause.

In our emails she had said she had seen a liver shunt in 2 of her dogs before and the people.were real njce and classy and she just replaced their puppys and they were bappy. She stated her could make me the same offer. I asked her about providing me with a clean health record including an acid bike test as I cannot afford not bear to see another dog with this condition. She never addressed this or any other offers of resolution I attempted. Instead her responses were to intimidate and threaten me. I have not committed slander. Everything I say is true, and I have that proof. She has never asked for any proof. She just wants me to go away. My dogs current meds & diet cost approx. $200/mo. She will also need continual Vet visits & bile testing. My veterinarian is treating my dog until I am able to afford the surgery. The medical records include her presumptive diagnosis and treatment plan until I can afford this expensive surgery. The severity of the shunt may only allow me a year maybe more, maybe less before she seizes and dies. She didn't deserve this death sentence by a bad breeder who continues to breed and sell offspring of my dogs parents, and at least one parent carries the gene for the shunt.

I will not unless court ordered or if she dies, return Tori back or trade for possibly another sick pup from Ms. Roberts . Tori endured the first 7 mo. of life, while sick with this breeder allowing her to suffer.I have spent $3000 obtaining her, and in vet bills, tests, medications and prescription diet. If Tori were returned to this breeder she would be culled as she is an expense, not income. or worse left to die unmedicated. Even a worse scenario,  resold to another person without disclosure of her disease. Tori has a 95% chance to be normal with surgery to repair the shunt. She has the possibility to live a full life, and be medication and diet free with surgery. Currently I have created a Go Fund Me account to try to raise funds for her surgery. It a slow battle. I have made $375. My goal needed is $5000. At this rate she may not be here if I ever got enough for surgery. Also, I have contacted the Oregon Dept. Of Justice and filed a complaint. Their job is only to act as a mediator. If we are not able to come to terms,  they have advised me they cannot offer legal help and I will need to seek legal options on my own. Another expense I am not able to fund. Do I spend my money on a lawyer or to keep my dog alive.

May be I am making the wrong choice, but I choose my dog. Everytime. I find it puzzling that she cannot be prosecuted for fraud by altering the contract. The DOJ form states that based on the information provided they may refer my case to other agencies. I have filed a report with Better Business Bureau,  Consumer Complaints, and given a review anywhere I find her selling puppies on the internet. On Facebook Ms. Roberts waits for other breeders to post their puppies for sale and then she "piggybacks" their posts by commenting "I have puppies for sale in Oregon " and proceeds to "steal" the original posters potential clients. I have received messages from 2 other buyers regarding they also had a sick dog, but based on Ms. Roberts nasty disposition took on the responsibility themselves and did not have anything further with her. I have also contacted another breeder in her area who has stated she was "friends " with Ms. Roberts until last summer when this other breeder was also sold several sick puppies. One died, one suffers a collapsing trachea, and a 3rd which is healthy.

She also said that Ms Roberts would not allow anyone into her kennels,  including other breeders. Ms. Roberts currently has her home for sale by Century 21 Realtors for a price of $980,000. The ad has the following: Included in the sale is a very profitable/successful dog breeding business. Established for 35 years currently grossing over 200k. Kennel license is current and approved for transfer to the new owner. Current owner will be available for consultation. 45 breeding dogs of French Bulldogs, Yorkies, Chihuahuas and Brussels. outbuildings 12x24 kennel. Small space for 45 dogs that are never outside (which is required one hour per day by Oregon law), and their puppies, and she's selling them like a piece of furniture with the sale of the house. Today, she has 16 puppies for sale on Puppyfind. Of more breeds than listed above.  I have also discovered her on a website as a "B" breeder,  aka: butcher's, who sell puppies to labs to be used in experiments.

Everyday, I am discovering additional information of laws, or her actions, or.other buyer problems. Oregon Dept. Of Justice wrote their first letter to her on June 22, 2018. The letter states she should correspond durectly with me, and send them a copy. I have a feeling that avenue won't be productive based on our earlier contact. My contract may read I have to return Tori to receive any type of reimbursement from the breeder. However Oregon Law has provisions that change that requirement if the breeder did not do certain conditions. She didn't disclose she knew the dog was sick when I bought it. The basic one. On her final email to me, she finally addressed the incorrect vaccinations records. Now claiming the dog I bought was Hannah. I never heard of a dog named Hannah. She sent.me.emails prior to my arrival at her home of Hailey, Tawny and Bijou. When i arrived I was only shown Hailey and Bijou. I choose Bijou. She now claims it was Hannah, Bijou and Dina i viewed at her home. Not true. And she never disputed I bought Bijou prior.

I had found her on Facebook in a group called Yorkie Addiction in February 2018 and sent her a "friends request". I immediately received a Facebook Messenger response asking "What can I do for you?" Seemed a bit abrupt. I explained who I was and that I bought Bijou and just wanted to add her so she could watch her progress. She emailed back and became very nice. I constantly referred to the dog as Bijou aka Tori which she never disputed. Amazing she was also able to immediately respond via Facebook Messenger, but when I made this contact in May 2018. regarding Tori's condition she wants to claim she never received them until after our other unproductive emails. Back.to the issues at hand. This case is growing each day. It need to be resolved. I can't do it alone. HELP! I have alot.of additional information and documents.
