On 4/23/07 I ordered clothing from this company's website. The total for this was $168, which was paid in full. On 4/25/07 I received an email from the company that my products would be shipped. On 4/27/07 I received all products but they were too small. I emailed the company asking for a return form, and informed them that I am returning all products. Jennifer Lutke (owner) emailed back and said she would forward me the form. I never received the form. On 5/1/07 I mailed all products back to the company via Priority Mail with Signature Confirmation Receipt. On 5/3/07 the products were delivered via the USPS website and were signed by K FPEED. I emailed the company asking when I should receive my refund of $168.00 (cost of goods less shipping) several times with no response. I have found several complaints on the web about Doxy Lingerie so I emailed the links to them asking them if these reports are true - hoping to get some type of response from this company. Finally I received an email back stating they were unable to locate the products I returned even though I have a delivery receipt and the return was signed for. With this proof I told them that I was not my fault they mis-placed the returned items and that I should be refunded the $168.00. The response was their stated return policy is that it takes 2-3 weeks for refund to post upon receiving the return. My response to them was "Per the USPS website and delivery confirmation receipt the products were returned and delivered to you on 5/3/07. Tomorrow, 5/24/07, is exactly 3 weeks from 5/3/07. My refund should be posted tomorrow per your guidlines. After tomorrow you are exceeding the limitations that you set forth and are not abiding by your own rules. Please refund to my account tomorrow." I did not receive any type of communication from them until 6/1/07 which was "We have received and processed your return. Unfortunately, our payment system is currently down, and we will be unable to process refund for 1-2 weeks. Due to this, we have gone ahead and issued you store credit for the amount of your return. Should you have any questions, please feel free to contact us back." NOW THEIR PAYMENT SYSTEM IS DOWN AND THEY ARE GIVING MY AN IN STORE CREDIT! I reponded to them telling them I don't want an in store credit! I want my money back!! Don't ever purchase from this company. They are very hard to get in touch with, and with proof of return they will not refund your money! How can a company's payment system be down? This is ridiculous! Please read the numerous complaints on the web about this company! If you also get ripped off file a complaint with the Missouri BBB and the Attorney General of Missouri. They are trying to shut down this company! With your help it can be done!

I really don't think you have anything to worry about. I looked them up on the Missouri BBB and this is what I saw:

Government Actions

"On December 5, 2006 Missouri Attorney General Jay Nixon filed suit against Jennifer Lutke, owner of Doxy Lingerie. The Attorney General seeks to close down the St. Louis Internet business that allegedly took payments from consumers for lingerie and other accessories but failed to deliver the items for weeks or months, if ever. Nixon's lawsuit is asking the St. Louis County Circuit Court for consumer restitution and an injunction to stop her from violating Missouri consumer protection laws.

Doxy Lingerie sells lingerie, costumes, garments, and other accessories from its Web site. Many of the items sold are marketed for time-sensitive events, such as lingerie for honeymoons or costumes for Halloween parties.

Customers who ordered merchandise online with a credit card were told their orders would be shipped within 24 to 48 hours or the next business day if the item was in stock, and within two to 14 days if the item wasn't in stock. Consumers were also given an order number and told that they could track their order online.

Nixon alleges that while the consumers' credit cards were generally charged the next business day, they would be forced to wait weeks or months for their orders, making the purchase worthless for those who bought the items for specific events. Many items never arrived at all, or arrived with items missing. Consumers were unable to track their orders on line, weren't able to speak with anyone by phone at the company, and had email messages inquiring about the status of their order unanswered for days, if ever.

"There are many consumers across the country who sent payments to Doxy Lingerie but who don't have merchandise, refunds, or answers," Nixon said. "We are asking the court to shut down this business and order restitution for these consumers."

The Attorney General's Office and the St. Louis Better Business Bureau have received approximately 90 complaints from around the country so far about Doxy Lingerie, with some consumers saying they paid more than $300 for merchandise. Despite claims on the Web site of a "No Hassle, 30-Day, Money Back Return Policy," these consumers have not received their merchandise or a refund, Nixon said.

Nixon is asking the court to grant a temporary restraining order and preliminary and permanent injunctions prohibiting the defendant from advertising and operating any business in Missouri.

The lawsuit also asks the court to order Lutke to pay restitution to compensate any consumer who suffered a financial loss in the case; to make payment to the Missouri Merchandising Practices Revolving Fund in an amount equal to 10% of the total restitution paid; to pay the state civil penalties of up to $1,000 for every violation of state consumer protection laws; and to pay for the costs of the investigation and prosecution of the case. The case is currently pending."

They have other things to worry about than a case of slander against you. Besides I read your report and I can't find where you slandered them anyway. You were only telling other people about your experience with this company and that is what this website is for. I wouldn't worry about it.

Doxy Lingerie Filing Suit For Slander For Entering A Ripoff Report

After stating that I don't want an in store credit and that I want my money refunded (which I have asked for 7 times previously) Doxy replied and said "I will forward you the necessary paperwork to fill out in order to receive a refund via business check then."

My comment is that I've asked for my money back several times over and I keep getting the run around. Doxy saw my ripoff report and replied with "I just saw your report. I have forwarded it to our attorney. He is looking into a suit for slander, as we have kept in constant contact with your regarding this issue and have offered a full refund."

If Doxy intended on giving me my money back they would've done so several weeks ago when I asked the first time. Rather, they replied and said their payment system is down and that they would give me an in store credit. Again, I replied with I want my money back.

Now, they are going to forward me a form to fill out to get cash back for the products I returned to them via delivery receipt which were in fact signed for over 5 weeks ago. It's simple. Give me my money back. Rather they have threatened to file a suit for slander against me. Why? Because I filed a ripoff report with all the facts.

If Doxy ever refunds my money I will revoke the ripoff report. Until then I've considered this company a complete Ripoff!
