DRE Auto Sales Refused to refund $100 deposit check after selling the car we put the money down on! Cedar Hill, Missouri

I went to DRE Auto Sales on October 3, 2011 and put $100 down on a 2001 Ford Expedition I was to pay $2,800.  I asked Doug Edler to have it inspected and I would be back to purchase it in a few days.  I called him on the 8th of October to see if the car was ready to get picked up and at this point he informed me that he sold the car the day before.  I asked him at this time to rip my check up. 

I recently got my bank statement and it showed that he cashed the check anyway.  He said I walked from the deal and he began to argue with me.  I feel he should have returned my check or did what he said he was going to do and rip it up!!
