I received a check from my insurance company after hitting a deer. This was in October 2007. The check had to be signed by myself and my lien holder which is Drive Financial Services. However, I never endorsed the check when it was sent in. I called Drive and asked for the address in which to send the check to be endorsed. I enclosed a letter to endorse and send back to the following address.
To make a long story short it is now March of 2008 and I still have not received the check back.
The check was applied to my account and after numerous phone calls to the company finally in February the payment was reversed. Why should I pay my monthly payment when they had obviously taken my money to repair my car. Which left me with $1700.00 I had to come up with to make my account current. They never admitted to the mistake. I was even sent a letter that they were going to repo my car.
I called the company repeatedly and got a different story everytime. One women said to send in a dispute letter and they the payment would be reversed back to my account.
Another employee said that I sent it to the wrong address. A manager argued with me and said my payments were extremely past due since September. Which I was behind but only $200.00 when I pulled my last statements and examined them closely.
All in all I have been harrassed, lied to and stolen from. I feel that I am in a hopeless situation. I was charged late fees after the insurance money was deducted from my account and told that 50% of the late fees would be deducted. Haven't followed up on that yet but what is the point they probably lied again.
I was told to put my car in the shop and the payment would by forwarded to the repair shop. However, I don't even believe that.

not smart...if this company has the lien on your vehicle, they are the "loss payee", if they issued you a check in your name only, that's a no no.. this company may end up suing your insurance company, and then when they lose, they (the insurance company) will pursue you for the amount of the check and likely drop you as a customer.
It's not your insurance money if the car is not paid off........

here's the story with insurance repair checks and auto finance companies.....folks often attempt to cash the insurance check and not repair the vehicle....so the finance companies require that the customer endorse the check and send it to them with a repair estimate or invoice from a repair shop...the company then endorses the check and then sends it to the repair shop...the vehicle is then fixed..
if customer's account is delinquent and they refuse to have the vehicle repaired or refuse to endorse the check....the company can apply it to the past due balance on the loan. It's all in your contract and all very legal.
Remember...unless the lien on the vehicle has been satisfied....(the contract paid off) it's not YOUR money

I have the same thing going on now we had vandalism done to our car and the check was made out to me and the them they told me to send the check in and they would mail it back to me endorsed... I am a very untrusting person so I never signed the check they said they would send it back as soon as they got it. I over nighted the check to them and that was in the beginning of June and we have got the run around they haven't paid the people who were going to fix the car and said they weren't going to so we told them to send us the check so we could fix it then and they told us they couldnt do that and when I check on my account they had cashed it and put it toward my account WITHOUT ME EVER SIGNING IT.. and then this morning they came and repossed my car saying we werent paying why pay when they have 1300 dollars of my money that I Had to come out of pocket with to make the car drivable.... We have contacted lawyers and they said they would see what they can do what are normal people supposed to do.. STAY AWAY FROM THIS COMPANY AND CAN ANYONE HELP ME?

I had the same problem with Drive in Regards to an insurance check. I didn't endorse the back of the check and they kept giving me the run around for about 2 months and I couldn't get the car fixed so I finally contacted my insurance company and explained the situation to them so they placed a stop payment on their check and issued me and the shop where I had the repairs done a check. Needless to say Drive was stuck with a worthless piece of paper. Please refer to the other reports that I have put on this system about Drive back in June/July of 2007 and February 2008 to see the other nightmares that I have about them. One way to stop them is to file a complaint with the FTC and your State Attorney General's Office until someone can figure out a way to get a class action lawsuit against them since our personal information can't be published on this site.
