My husband has made 58 pmts and still owes 3500.00 .He had the acct long before we met... he did get behind and never caught up due to pay cuts.. and will remain behind until paid off.. , He's had his acct since 2003 and since all his referrence had to change thier phone numbers to stop the calls. I put myself on as a reference so i could make pmt arrrangements for him..They call his work 3x a day, they even called my work (must have gotten the number from caller id when i made an arrangement from work) I told them several times to "NOT CALL MY WORK" and they said they "took the number out of the system" but still called... Im not even on his acct.. I also have a problem with thier online website.. It's funny how you cant log on using the correct info, they walk you thru a verification every time.. then they give you the same correct info you tried using to get logged in.. Now the website is down. So cant see the acct .. well probably because we ignore every call so they blocked us from getting into our acct, just to get us to call.. This company take advantage of people with bad/limited credit. I can say that.. They are a high risk lender. But come on they need to train thier employees on customer service!!! Believe me you cant get blood out of a turnip, and you get alot more bees with honey.. We have many bills and drive is the last one on the list do to thier unprofessionlism and they dont know where we live! By the time we pay off the loan on this 2003 Mercury Sable we will have paid over $30K FOR IT..LOL You live and you learn

- The loan is based on you(or your husband) making payments ON-TIME, EVERY month for the life of the loan. If you make your payments after the due date you are assessed additional interest.
In looking at your numbers, even if we figure his first payment was 12/2003, he should have made about 68 payments. So he is around 10 payments SHORT(we are talking almost an entire year). Being this short I am surprised about a couple of things. First that he owes only $3500, and second that they have not actually reposessed the car yet.
However, you have one thing going for you in that you live in CA. You can use the "California Rosenthal Fair Debt Collection Practices Act". This requires an original creditor to stop contacting you if you request it. But be careful, especially if you feel they can be the last one you are going to pay. Until the car is paid off they have the legal right to reposess the car. By cutting off communication they could figure that you have no intention of paying them. So they will come and get the car.
Also, don't think you are safe in them not knowing where you live. Because there is a very good chance that they do, unless you are falsifying your information with the DMV. But if they feel you are hiding the car they will just use the Courts to force you to turn over the car.
