Our client had developed an ecommernce website for DUTCHKID FZ LLC. The site link is justkidding-me.com It was supposed to be a project of 3 months but due to change in brief and their internal team resource changes, the project stretched for over 20 months

The e-commerce project which was undertaken in 2013 was delayed and the work was completed in Sep 2014 due to which our client had to incur significant losses. The time logged by the development team for this project was almost 5 times than a normal ecommerce project and this resulted in increase in the expenses which our client paid on behalf of DUTCHKID FZ LLC
Additional expenses incurred were for (and not limited to)
  • Travelling expense and stay of our development resources between countries
  • Changes in modules already developed
  • Changes in briefs
  • Additional modules integration
  • Training of their inefficient employees (2 of them left during training and the same had to be done again)
All this can be proved via the email exchanges between our client and DUTCHKID FZ LLC

We have email archives of the last 2 years between our client and DUTCHKID FZ LLC. There was no mention of not making the payment for the entire duration of 18 months. Once the website was made, DUTCHKID FZ LLC revoked all our access and refused to pay the outstanding amount which is AED 194,686

We have filed for a litigation and will soon go to court and the case shall be tried if the matter is not addressed to our client's satisfaction by end of this month

Mr Williem, as you know, the e-commerce project which was undertaken by Gozoop in 2013 was delayed due to which Gozoop had to incur significant losses. The time logged by our development team for this project was almost 5 times than a normal ecommerce project and the initial investment of AED 42,000 does not apply any more. The value of the project has increased much more than the original quote of AED 42,000.

I will be receiving the email archives of the last 2 years which my team will go through over a period of next 1 week. Once my team goes through the entire email correspondence between the two teams in last 2 years, I will get back to you with the proposed terms which may include (but shall not be limited to)
  • Revised amount which could be in much higher than the original quote of AED 42,000
  • Accrued interest on delayed outstanding payment
  • Additional Charges not billed earlier - hosting charges during testing phase, cost of plugins (approvals for which were given by JK)
  • Additional charges for work done which were not part of original scope of work (There are numerous features that were added which were not part of the initial scope of work)
  • There was a lot of work that had to be redone since there was no clarity of thought due to too many points of contact for this project at JustKidding. That will be added to the final quote as well
  • Miscellaneous charges, if any
We have been told that there are many features which were included in the scope of work were not completed. However, we do not agree with the same.
We have a backup of the ecommerce solution as of 20th Oct 2014 post which the website was transferred on a new hosting the cpanel details of which were not shared with us

I would request you to take a current backup of your existing ecomerce solution so that we could compare features and see which of them were incomplete and not as per their brief. Note that we also have the list of pending issues sheet where almost all of the original features in the scope of work (Phase 1) was approved by Just Kidding team

I shall send across the revised terms, by mid May and if we fail to receive a satisfactory reply within 14 days of the date of receipt of the email, we will be constrained to take the legal route

I will be your point of contact regarding this issue moving on. In case you have any questions, please free to let me know

In case we decide to not settle out of the court, my team would be coming over to Dubai at the end of May and along with our associates in Dubai (UAE), we shall take it forward from there.
