Well, I finally downloaded the actual documents of the Federal District Court case that Robert the liar Krutko did not lose. LMAO.

August 3, 2006: Krutko signed for receipt of certified, return receipt requested letter to Laura Krutko (president, Reef Snorkeling Adventures Inc.) Letter demanded payment of dockage and other fees that are owed to Ocean Keys Resort (owned by Seaboard.) No payment by RSA for dockage fees for the period of December, 2005 through November 2006. Letter also informs RSA that if the billing isn't paid that the boat will be sold 60 days after receipt of the demand letter. Dockage agreement was signed by RSA representative and stipulates that month-to-month dockage is $4500.

NOTE: Krutko told the GCMA that he was a month-to-month at $3000 which was printed in their March 2007 Newsletter. IMO, this was a blatant LIE by Krutko. This makes 2 lies I can substantiate by this LIAR. The dockage agreement clearly states that if the yearly lease is not renewed (at $3000 per month for a one year lease) that the dockage goes to a month-to-month lease with monthly fees of $4500.) The first lie was his posting on ROR claiming that I was an employee of United Yachts.

What this fool should know is that when you buy a corporation, you acquire assets (such as the vessel) AND THE LIABILITIES (lease for dock space.) When this jerk purchased RSA he also purchased a valid lease for the dockage. Further, after the lease expired, he paid the $3000 (deposit per the lease contract) in November 2005. The boat was also SERVICED in November 2005.

Details of Federal District Court Case 0:07-cv-60001-JEM:

January 3, 2007: Complaint entered into docket: CASE NO: 07-60001 CIV MARTINEZ. Suit seeks enforcement of lien authorized by Florida statutes. Suit seeks $60,683.86 due to Seaboard (owner of Ocean Key Resort) for dockage and other fees owed.

July 9, 2007: The attorney representing RSA (KRUTKO) filed with the court a motion to withdraw as counsel. One of the reasons given was: There has been no cooperation or Response from the client in regards to the substance of his case for a while.

July 17, 2007: Judge Jose E. Martinez grants motions for defense counsel to withdrawal as attorney of record and orders defendant to obtain counsel or face default judgment.

July 17, 2007: Judge Jose E. Martinez grants motion to force sale of the vessel. It should be noted that RSA (Krutko) did not provide any defense to the motion to force a sale.

October 31, 2007: Judge Jose E. Martinez grants judgment for Seaboard ($65,230.87 plus pre-judgment and post-judgment.) This sure looks like a LOST THE CASE to me. Go ahead Robert! Please explain how this is a WIN for you! LOL!

November 5, 2007: Judge JOSE E. MARTINEZ orders award of custodial fees and credit bid ($16,320.50).

November 6, 2007: S/V REEF CAT sold at marshal's sale to Seaboard for $25,000.

November 21, 2007: Judge Jose E. Martinez orders amended final judgment in the principal amount of $65,230.87, plus $10,071.10 in prejudgment interest for a total award of $75, 301.97.

July 30, 2008: U.S. Magistrate Judge Barry L. Garber orders additional relief to Seaboard; $2,855.08.

The reality is the document states a dissolution approval date and the form is signed (but not dated) by Laura Krutko, but the EFFECTIVE DATE was left blank. Go ahead. Take all the time you need to explain this one.

When are you going to make these court documents available to Mr. McCarthy so he can read for himself what really transpired during the lawsuit against you? Don't' forget to include the evidentiary documents filed by the plaintiff that include the investigative reports and statements from the folks who were on the scene when the vessel was adrift.

When are you going to provide Mr. McCarthy a copy of the judge's order that denied your motion to dismiss so that he can read for himself what you attempted to do and the judge's STATEMENTS as to WHY your evidentiary documents were "HIGHLY SUSPICIOUS" and he denied your motion?

It has been brought to my attention that about a year ago a boat was stolen in Key West which I believe is grand theft and should be brought to trial or at the very least an investigation should be done. In this particular case it seems that neither was done. That it was called a civil case. I'm sure I don't have to tell you that stealing a boat is not a civil matter. It has caused great hardsh ip on the family that owned the boat. It was not just a boat for recreation but a boat that was used commercially to provide an income. The family that is the victim is from Ohio. This is the last thing that we need in the Keys is for justice not to be done. We rely on tourism down here and what we don't want is for these beautiful islands to get a bad reputation that when something happens everyone just looks the other way. I truly am urging you to conduct an investigation into the matter. If you have any questions please feel free to contact me.

Mr. Krutko's boat (who I have never met) had been anchored in Cudjoe
Bay, broke anchor and was drifting towards my boat and dock. The phone
number printed on the side of the boat was not a working phone number. I
contacted the Coast Guard and the Marine Patrol/FWC. One o f the 2
agencies (I cant remember which) recognized the name of the boat and
told me it was usually docked at the Ocean Key Resort and I should
contact them. Both agencies stated if I towed the boat to deeper water
to secure it I would then be held responsible if it broke anchor again.
I called the Ocean Key House and was transferred to John Evans who was
very excited I had found His boat. He told me a disgruntled employee had
disappeared along with the boat. I left work early and when I arrived
home I believe there was a FWC boat, a Law Enforcement boat and a Sea
Tow Inflatable near my dock. The two larger vessels "escorted"/
"sandwiched" the vessel in question to deeper water minutes before the
vessel would have come in contact with mine. As they were reaching
deeper water I saw another boat with a driver and passenger approaching
the scene. One of the men boarded the vessel and eventually started the
engines. He yelled to me He was John Evans and He told me to come down
to the Ocean Key House for a free dinner on the resort as a reward for
finding the boat. I told Him there was no need for the reward I was just
happy He recovered His boat and there was no damage to my property. On
1/12/07 J ohn Evans contacted me again asking more information about the
incident saying the FWC stated they were never on the scene. I said that
was crazy and I had photo's proving it. I burned a disc and gave it to
John who then insisted my wife and I go and have a free dinner. We did
go have a great meal on 1/31/07. All my photo's have now been provided
to John Evans, Robert krutko and Charles Tunnicliff (850 4879656) of the
Dept. of Business and Professional Regulations.

I believe that by now you have become acquainted with the case that is now over 18 months old. For whatever reasons the case sounds to have been mishandled, I am asking you to open a formal invstigation in this matter. No one deserves to have their property stolen from them.
As a resident of this county for over 23 years, I love living here and do not intend to leave. The negative impact of these allegations is really a bad thing, and I hope there is a way to at least get this man's property restored to him.
The headline on Craigs List cast all members of my Realtor profession in the Keys in a very bad light, but worst of all, Mr. Krutco says that he has convinced several people not to move here b ecause of the "lawless" conditions. Please rectify this injustice, because you may be helping to save a major portion of our economy as well as putting the ofenders in jail, or better yet get them to pay restitution for their crimes.

My name is Kevin McCarthy I own and operate Amelia River Cruises & Charters in Fernandina Beach, Florida. In the fall of 2006 my wife and I drove to Key West to look at20a few commercial tour boats that were for sale. We looked at a 45' 49 passenger U.S. Coast Guard Inspected vessel that was chained to the dock at the Ocean Key House Resort. The asking price was $110,000 the broker informed me that there were outstanding dock fees and that is why the vessel had been chained to the dock. I expressed an interest and told the broker that I would make an offer in a week or so. Two days latter the broker called to inform me that the vessel was to be auction off the very next morning at the Ocean Key House Resort and that the hotel had taken possession of the vessel for the delinquent dock fees and the starting bid would be $61,000. The next morning I called the Resort and spoke with the manager Mr. Steve Boswell I asked him if in fact the vessel was to be auctioned off that morning his response was yes and then he handed the phone to his attorney Allen Eckstein. I asked Mr. Eckstein if the Resort now owned the vessel and if there were any other outstanding leans on the vessel. Mr. Eckstein told me that the Resort did now own the vessel and that there were no other outstanding leans. I them called the broker to ask if he coul d attend the auction on my behalf, I authorized him to bid up to $71,000 plus a 10% broker fee for him. At 10:15 that morning I received a call form the broker that the boat was mine for $71,000. I received a bill of sale from attorney Eckstein and took possession of the vessel. After a month i n dry dock and with about $20,000 in repairs my wife and I were sailing our new tour boat from Marathon Key north to Amelia Island Florida. We stopped in Miami that first night and I received a phone call From Mr. Robert Krutko, Robert explained to me that I did not own the vessel and that it had been st olen from him. I then called Attorney Eckstein he assured me that the vessel was in fact mine and the everything had been done lawfully, My next call was to a Maritime Attorney in Miami I explained my situation to him,
his first question to me was did the Resort arrest the vessel and was there a U.S. Marshal at the auction my answer was no. The Attorney then told me that I in fact could not own the vessel and that the transaction in his opinion was not done poperly. By this time we were on our way to Ft. Lauderdale and I had made arraignments to stop at First Performance Marina for some engine repair. Just as we were pulling in to the marina we were boarded by the U.S.Coast Guard and then the Broward County Sheriffs Department they looked at my bill of sale they both told me th at the bill of sale was not worth the paper it was written on. I then made arraignments with the marina to leave the boat there and we returned to north Florida that was the last time I saw the boat and I was out $91,000. I then hired an attorney in Jacksonville and after about a month of haggling the r esort did return my purchase price of=2 0$71,000 and the broker did return his 10% fee.
I am out at lest $20,000 and the hole ordeal has been a nightmare. I am convinced that the Ocean Key House Resort ,Mr.Steve Boswell, Attorney Allen Eckstein and Mr. John Evens the young man that hot-wired and then removed the vessel from Cudjoe Bay and returned it back to the resort all participated in the Grand theft of this vessel. I am also convinced that had the Monroe County Sheriff's Department the F.W.C and the States Attorney's office in Key West had done there jobs I would not have had to endure this nightmare. Mr. Krutko and I do not have the financial were with all to go after this type of injustice and I am very disappointed in the way this has been handled by those governmental organization that are sworn to up hold the laws in this state.

I have just arrived home from a great trip to Key West, FL, but feel obliged to tell you all, at all costs avoid the jet skiing which can be found at 0 Duval Street, (Old Town Tours).

The jet skiing was fun and fast, however be warned that you may be conned in to paying for damages that you have not caused. My party of four were accused of having a collision that DEFINITELY DID NOT OCCUR. We obviously refuted the claim, however the staff were rude and ignorant, basically accusing us of lying, although they have no proof of a collision and who may have been involved. They charged $200 to a credit card of one of my party, and not even the credit card of the person riding the specific ski they found fault with. This was after telling us, one of us should 'FESS UP'. We only found out who rode that ski when later looking at photos and camera footage. There was also no communication in relation to how much would be charged. We had to challenge them for that information.

The fault, apparently, was a very small patch of flakey paint above the thick rubber bumper at a rear corner. NO SCUFF MARKS, NO DENTS AND NO CRACKS, and NO damage to any other ski. The damage could not have been caused by a collision, it was nothing more than wear and tear. This was exacerbated by the staff who began picking at it and who also rode the skis very fast themselves around the small docking area in order to dock them once we had handed them over.

There are plenty of other jet skiing locations, I suggest you try one of them.
