Earthlink called me on the phone one evening and offered me a great deal on internet access. I asked the saleswoman if it was guaranteed and she said yes and that if I had any problems and the modem did not work I could cancel and they would pay the return postage for return shiping for the modem.

Well I decided to give it a try and 4 months later it still would not work. I strongly believe that their modems are too cheap to do the job. I say this because I had DSL for over a year on that same phone line with another company and it never had a problem. The phone line was never tampered with - I just removed the old DSL modem and installed the new one so I know it was the crappy modem.

I spent over 30 hours on the phone with their tech support - and they even sent me a second modem - at their insistance not mine - and it still did not work. I contacted their billing dept about the charges on my credit card and I told them that the DSL was never working but they got very hardnosed with me and told me that if I cancelled they would charge me a for early cancelation and for the modems.

Well I cancelled my credit card so they could not do this. They still charged me about $50-$60 several months before that to ship me the modem and for service that I never had and I want that money refunded. It was to late to get my credit card company to refund the charges. Earthlink also put a bad mark on my credit report and they claim I owe them over $300.00.

THIS IS A TOTAL RIPPOFF COMPANY AND I WOULD NEVER ADVISE YOU DO BUSINESS WITH THEM FOR ANY REASON. I want my credit report fixed and a apoligy from this company or I may even seek legal action against this company. I later found out that one of the Earthlink family of companys is a company called Netcom Inc. - another company who ripped me off way back in 1985 with the same basic rippoff scheme - You can not cancel their service because they retain your credit card information and keep billing you anyways.

I am checking into the practice of storing credit card information and to see if it violates any laws to store peoples credit card information in their private databases. It seems to me that this practice of storing credit card information in this manner should be illegal and is a very dangerous practice FOR THE CONSUMERS.

This company will eventually pay for this one way or the other because I am not going to be passive about what has happened to me. I am going to let everyone I know what happened to me. I am also contacting large Earthlink shareholders and newspaper reporters - eventually these scumbag companys will be exposed the rat bastards that they are.

If Earthlink has ripped you off - do the right thing and fill out a report here and let others know. I also reported Earthlink to the BBB but they have been reported so many times before that my report was like a drop in the bucket and nothing was done.

Howdy Dwight. I don't think you are going to like me, but you might want to read on and save yourself some embarrassment later.

The fact that your experience with a company the size of Earthlink was not to your liking does not make Earthlink guilty of illegal activity. Far from it, for they have a large legal department charged with doing nothing but churning out all those little tiny words that cleverly separate the corporation from just about any liability you could ever think of.

Were I facing such a dilemma, I would make it my business to know everything about ADSL as it pertains to home use, and while doing this I would find out that there is no liability incurred by the provider if the connection does not perform up to spec.

If this is really about ADSL, then there are plenty of companies who can be depended on to provide the service.

It is just going to be expensive because the phone company is involved at some point in the provisioning chain. As more and more local ISPs buy into the hardware side, there will be no reason why broadband should cost anymore than the cheapest dial-up accounts do now.

It really looks like you have messed your self up by closing an account to avoid collection. You can always dispute a charge with your bank or credit card provider. In this case, it is going to look like plain non payment, and like it or not, some place in those little words you agreed to pay so much for Earthlink to make an effort to provide something.

I really hope that you get out of this without damaging your credit. I have no respect or love for these big ISPs by the way; they do give some folks the short end. Trouble is they do it legally. Were I in your situation, I would attempt a resolution in the same manner.
