EASTERN BANK DO NO REAFFIRM A DEBT WITH this bank if you file bankruptcy, they will make your auto loan look like you never paid for it and its repoed even if you pay them perfectly after you file bankruptcy. Lynn Massachusetts

I filed CH7 Bankruptcy on 2005. And I wanted to make Good on my car a 2003 Dodge Neon SXT. I wanted to be good with this bank since they made me a loan. So I paid them the 249.00 per month faithfully every month for the past 4 years. I went to buy another car. I found out that Eastern Bank put on my credit that I never paid for the car and it looks like a repo. If anyone who reads this and has the misfourtune of Bankruptcy. DO NOT REAFFIRM with this bank, they will change you CURRENT NEVER LATE to CHARGED OFF in bankruptcy. I cant get an auto loan because of this. Do not trust this Bank.

Bankruptcy...

There does not appear to be a RipOff here, but there are some things you need to check.

When you declare bankruptcy you include all of your debts. It is up to you if you continue to pay on the secured assets(Car) or turn them in. The fact that it was included in the BK does not change. As such there are certain guidelines for what must be reported on your credit report. There are two possible valid status on your credit report for this loan.

"Included in Bankruptcy-Reaffirmed"
If you actually signed a reaffirmation agreement then the status would be changed to this(or something similar).

"Included in Bankruptcy"
If you did not actually sign the agreement but still kept paying the loan will show as this. It would actually not matter if you kept the car or turned it in this status would be the same without a signed agreement.


So the only valid dispute you would have is if your credit report does not show the correct status for the case if you did or did not sign the agreement. This is not for just this bank but for any secured loan you would have had at any bank.
