I received email from eBay after offering a "Buy it now" price to a seller. eBay says the email was a spoof and any loss due to it is the responsiblity of the buyer. The problem is that people are inside their software and can generate emails that show up in a mailbox as being sent by eBay. As a result, first time buyers can be ripped off rather easily. If you have been ripped off by someone who generated mail from eBay to you, please contact me. I am trying to put together a class action lawsuit. Thank you.

EBAy had nothing to do with those emails
The scammers did not use EBAY to send those emails.

I can make an email look like its sent from Ebay, easily; as do the scammers.

How can you tell its not from ebay? Learn to read the headers.

I can make a website completely look like ebay's (in fact, it was one of my school progjects for IT to discuss security). one can be made in all of 10 minutes.

Ebay has nothing to do with that email, and a class action lawsuit will do nothing, since EBAY has nothing to do with those emails.

Get that through your guys heads

I am also a victim of this fraud. And would be really interested in pursuing some legal action. It is Ebay responsibilty to protect my information and not treat their site like the wild west.

Why? Funny you should ask... It's because EBAY IS NOT AT FAULT. Jeeze people, what are you thinking? It's 3rd party scammers that is the problem, they have webites that look just like Ebay, Yahoo, and others. Their sole purpose in life is to screw you out of every penny you have for items that don't exist.

It's like trying to sue Rolex because you bought a 'Ro1ex' watch from some crack-head off the street and discovered it was a fake. Rolex has nothing to do with the crack-head, just like Ebay has nothing to do with the pigs that are scamming you.

I doubt any lawyers would even consider a case like this, or if they do, hahaha, they will scam you out of your hard-earned money, knowing they will lose the case, but so what, they got paid.

And you got your hand bit.

Offering a Buy it now, means that YOU initiated an off site sale, which EBAY never ever covers. YOU got caught violating their policies and from a seller who was a scammer. Typical of those who try to cheat the system blame ebay, when its expressly stated in their policies that such practices are NOT ALLOWED.

The best way to handle this problem is to change your email stats under your eBay account.

Under my eBay account, I have opted not to receive emails from eBay, including notifications of Paypal payments, questions from eBay users, etc, in case eBay may not have sent them. If such messages were indeed sent by eBay, they will appear in My Messages under your account. They did this to help buyers and sellers avoid these fraudulent emails.

You might also try blocking any email that came from Ebay or eBay inc. in your email account, which is a common sender of fraudulent emails. (I personally have not done this, but it might be a good idea)

I know how you feel, as I was suckered into this problem myself at one point, but eBay cannot be held liable for it just because somebody stole their logo, created a fake email from it, and used it against you. These unlawful practices are common, and not just with eBay. The only thing anybody can do is to take precautionary steps, and know how to avoid becoming a victim of spam or phish emails.

Remember, eBay will never ask you for personal/sensitive information. If they do, it will appear under My Messages. eBay also has an article with more details on what to do about this.
