Granite the rent is $2,100 per month there about and the building was built in 1991 with limited slab cement that divides the apartments from floor to floor meaning noise from the upper floor will carry easily into my apartment. I signed everything they asked for and they started asking for more and more documents, including checking account statements. My checking accounts show an excess of $250,000.00. Elan then sent me more paper work signing to the effect that I will now start all utility services which I had to do so the manager can sign off and agree to rent to me. After setting up all moving needs such as truck and Hotels and utilities needed for the move Elan stated they are not renting to me. They are also aware I wasted a lot of time with their place and the date now is 5/23/08 and I have to show residency in this area because of a child custody case as I own homes in Nevada but cannot leave San Jose area because of visitation rights. Elan could care less about their Tenants or anyone. They also allow the Tenants to hang towels and blankets over their back yard balconies on the 4th floor which makes it look like a ghetto. As an end result after scamming fees and application cost they are trying to keep the extra fees charged such as $25. per applicant and charges my Visa $9.95 not once but twice. I am disputing the entire balances through the fraud department of Wells Fargo.

Thank you for the opportunity to explain lan at River Oaks rental criteria.
This blogger was a previous resident of Elan at River Oaks and wanted to become a resident again. Therefore, he and his wife utilized our online screening system to see if they could become pre-qualified for the apartment of their choice. The online pre-screening service, called Vaultware, charges a $9.95 non-refundable online convenience fee. Vaultware discloses that the fee is non-refundable prior to pre-screening. When a customer pre-qualifies online they are also provided a $50 coupon off their second month's rent which more than covers the $9.95 convenience fee. In addition to being pre-qualified, all applicants are required to verify their income, pay a $25 per person application fee, pay a $500 hold deposit and sign the required documents in order to reserve an apartment.
Unfortunately, in the pre-screening process, their credit score indicated that they posed a credit risk. Nonetheless, if all of the other application details were verifiable, Elan still agreed to rent to the couple with a higher deposit. At the time, the couple decided not to accept this offer, provide income verification, pay the $25 application fee, pay the $500 hold deposit, or sign any of the required documents in order to place the apartment on hold.
After a few weeks, the man stated that his wife was no longer going to live with him. He decided to pre-qualify again using the Vaultware automated online system; therefore, he was charged another $9.95 online convenience fee. The applicant signed all of the required paperwork to place the apartment on hold while his application was being processed.
In the end, unfortunately, this applicant's income could not be verified. The $250,000 in which he discusses in his blog was actually an equity line of credit on a home in Nevada deposited just weeks before applying for the apartment. This applicant could not provide a seasoned accounting of his income, so he could not qualify based upon the criteria every lan resident is held to.
Moreover, according to the agreement between lan and this applicant, he was refunded the $500 hold deposit he submitted. The only fees not refunded were the $25 non-refundable application fee and the two $9.95 non-refundable Vaultware online convenience fees.

Shea builder the owner of lan still has not resolved this issue or tried to rectify any or all of the complaint as of 7-19-08. Because of wrong doings they are having a hard time renting their apartments and have installed large signs in the front of lan to gets more tenants.
