I purchased a business in April of 2012. Upon ownership, I canceled services with evalon and decided to go with global pay instead to save on credit card processing expenses. I sold the business in December and canceled my account with global. However my account was still being debited. i contacted global and asked why they were still debiting from my account? They said my account was canceled and they were not debiting my account. I suspected fraudulent activities because my account was debited from hermitage Billing and I had no idea who they were. I went to US bank where my account was and ask them to investigate. Upon investigating Us Bank says it was Evalon their credit processing company. They had been stealing from me blind for the last 11 months and continue to do so. I contacted them and they said I never canceled with them. they never provided service for me but yet they took thousands from me without ever seeing that I never settled batch with or had a credit transaction with them. They deceptively stole thousands of dollars for almost a year for services they never provided. I am truly hurt by such malicious corporate greed. I feel an enormous need to bring forth litigation to ensure that this company does not continue these decptive practices upon other hard work small businesses.

Business owners need to be responsible

I worked for Elavon for 12 years. In that 12 years I heard all kinds of complaints about this fee or that fee and this rate is too high, on and on.
This complaint is one that I'm pretty sure goes back to the business owner. You can't blame a company for billing their fees on a monthly basis if you never made sure you cancelled the account.
Every time I sent in paperwork to cancel an account, it got cancelled. Every single time I heard a complaint about an account not being cancelled it was the business that handled the close request. Most all of them said they called in to cancel and didn't fill out a Close Form.
Elavon requires a signed Close Form to close an account. Can you imagine the chaos if disgruntled employees with access to the business tax id number could call in and close a merchant account? The required Close Form is for the merchants protection.
The guy wants to know why the processor still billed them after he didn't settle a batch. The processing companies don't assume. They don't say; Hmmmm, this guy hasn't processed in a few months. He must have changed to another processor so we should close this account. It is redicules to think that would happen.
Businesses shut down temporarily for remodeling and rebuilding and code violations and all kinds of reasons. It's not the processors job to assume anything to do with that business. They provide a service to the business.
Based on what I read in this complaint the business owner paid such close attention to his bank account that he didn't even know that he was being billed, or what he was being billed for. I would notice if "thousands of dollars" were leaving my account.
You can't blame the processor for billing a business for the service they make available to them, whether the business uses it or not.
I'd say the problem here lies with the business owner not giving due diligence to the details. Details like making sure the old merchant account is cancelled and knowing where his money is going for over 12 month. This is just another guy blaming someone else for his oversight.
