4.) When did the Transaction/Incident take occur?

Feb 13, 2014: Prior to this date, I had been searching the internet looking for a newer used vehicle. I came across a 2003 Honda Accord listed on the eliteimports.com website, and I immediately called the number listed and was transferred to a salesperson by the name of Issa. I asked Issa about the vehicle and if it were still available, He replied, that the vehicle actually was still available, and that he had several people that were interested and if I were serious I should come in soon as possible. At the time of our conversation I was working at a jobsite in Franklin, IN. and wasn’t able to make it in that day. So instead, I gave Issa all of my pertinent information over the phone to run a credit check to see if I would be approved for financing, after doing so he called me back in a couple hours saying that everything was perfectly fine and that I was good to go. After getting this information I asked a friend to stop by Elite Imports (4550 N. Keystone St Indpls, IN 46205) and give Issa a down payment to hold the vehicle, and I would pay them back later that day, since I was unable to make it in personally. Later that afternoon my friend met with Issa, and swiped their personal debit card for $500 and was charged a fee of $15.

Feb 14, 2014: The following day I went in to meet Issa personally and to give him the remaining portion of the down payment, which was $500 ($400 cash/$100 Personal Check). He said that everything was fine, as far as the financing, but asked that I come back the following day to sign the contract and allow them to clean up the vehicle and make some minor repairs, (i.e. replace wiper blades, replace left side head light). I told him, “that was fine no problem”.

Feb 15, 2014: I called to inquire about the status of the vehicle and was told they were extremely busy, and it wasn’t quite ready. So I told them it was no problem, I’ll stop by that Monday. I called Monday and was told yet again, that the vehicle was not quite ready.

Feb 18, 2014: I called Issa and was told my vehicle was ready for pickup, and I could come pick it up when ready. I took the afternoon off from work, so that I could finalize the deal. I arrived at the location early that afternoon, and had to wait in the lobby for several hours to sign documents and speak with Derrick who runs the financing department. After waiting patiently for several hours, I met with Derrick and signed the contract shook hands and he told me the  deal was done and I was good to go. He asked that I sit in the lobby, and they’d pull the vehicle around. After waiting another couple hours in the lobby, I was asked by a different sales person, had I been helped? I replied that I was waiting on my vehicle. He then found Issa, my original sales person, and he informed that the vehicle was not ready, and to return the next day.

Feb 19, 2014: I called the next day, and was told yet again the vehicle wasn’t ready. I said I’d try tomorrow.

Feb 20, 2014: I called once again, and was assured this time the vehicle was ready. I went into the location and after another couple hours of waiting in the lobby I was given possession of the vehicle.

Feb 21, 2014: I received a call from AFS Acceptance LLC, (954) 332-6826 P.O. Box 189007 Plantation Fl. 33318! I spoke with a Service Rep and was told that she needed to conduct a final interview over the phone to seal the deal. I explained to her that I was at work and at the moment it was not a good time to do so, she said that she would call back the following day.

Feb 22, 2014: The Service rep called to hold the interview and I answered all questions to her satisfaction, at the conclusion of our conversation she said that all was fine and the deal was finalized.

Feb 27, 2014: While starting the car this morning I had noticed the vehicle making an extremely loud whining noise, as it had done the day before. This morning like the previous we experienced sub zero temps overnight, I performed a Google search and came across an article from the Honda website saying the inclimate weather was the cause and what should be done to fix it. It stated that this was a common problem with that year of Hondas and it dealt with a sensor in the engine.

Feb 28, 2014: Unexpectedly I received yet another call from AFS financing, this time the Service rep told me that she needed to verify that my mortgage was current. She then called Bank of America, and we held a conference call. I gave BOA authorization to let AFS know that I was current and in good standing with my mortgage, it was done and the rep again said that things were now finalized. At the end of conversation, she asked about the car’s condition, and I told her about the noise I was hearing each morning.

Mar 3, 2014: I received a call from Issa at Elite Imports and was told that I should bring the car in immediately, and they would remedy the problem. I took the vehicle in and asked how long they’d think it would take for the repairs. Issa replied that it should take no more than a day or two. I said that was fine and that I had a friend coming pick me up.

Mar 6, 2014: I received a call from Derrick (Financing department) Elite Imports, he said that the initial financing had not gone through with AFS for some reason and that he found another lender. I was told to come in and sign the paper work and pick up the vehicle that day, when I arrived and at waited for several hours in the lobby, I was finally asked to sign the paper work. I asked was the vehicle ready and they told me “No”. They told me the parts had not yet arrived, and should be there shortly. I had to leave because I was tired of waiting and would return the next day.

Mar 8, 2014: I called the dealership again to check on the status of the vehicle, they said that it was ready for pickup. I then called a friend to drive me from Brownsburg to the dealership; once I arrived I had to wait over an hour to be seen, only to be told that the car was still not ready. I was told to come back the following week.

Mar 11, 2014: I called and was told the vehicle was ready. I had to pay a friend once again to drive from Brownsburg to the dealer to pick up the car. Only to wait for hours to be told the car isn’t ready, so I left and went back home.

Mar 14, 2014: I called again to check on the vehicle. This time I was told that I should speak with one of the owners, named Sam. Sam explained they had repairs they were still performing and that he would bring me a loaner car out to my home that I could drive, while repairs are being done. He said that I should wait for his phone call and he’d bring the car to my home and I would then drop him back off at the dealership. Sam never called and when I tried to reach him at dealership that same day, they kept placing me on hold and eventually told me that he was gone for the day.

Mar 18, 2014: I called again to check on the status of the vehicle and was transferred to Derrick in the Financing Dept., Derrick told me that he needed clarification on one thing and that I wanted for me to come in person to resolve the matter. I took off of work again and went to the dealership. I waited in the lobby for two hours before being seen. When I finally got to speak with Derrick he was telling me there was an issue with the amount of child support I was paying. I stated to Derrick that I had been straightforward with my credit issues and finances; and why hadn’t this been brought up initially? He began talking in circles and the only thing I kept hearing was something about a  budget being off. When asked for clarification he couldn’t explain to me what he was talking about. Instead he said he’d call the bank and straighten things all out, and get back with me the following day.

Mar 19, 2014: Again I called the dealership and was transferred to Derrick in the Financing Dept., he said, “come on in I took care of everything and your vehicle is ready”. I arrived and again had to wait in the lobby another hour, when I did speak with Derrick he told me to come into his office and close the door. He called the bank and placed the call on speaker phone to see about the approval status, the banker told him that he was still working on it and to call back in an hour or so, end of conversation. After Derrick hung up the phone he said this is what I’m going to do, I’m going to tell them that your ex-wife pays your mortgage since you pay so much child support and that you pay her $300 rent instead my total mortgage. At this point I was totally disgusted at their business tactics and walked out. Later that day I received a call from a Tony who works with CSF Finance company out of Richmond VA., (781)962-0144. Tony asked exactly what Derrick had stated, and wanted me to explain, as bad of a predicament I’m and needing a vehicle, I could not bring myself to lie and I told Tony the truth. Later that afternoon Derrick from Elite Imports called again to tell me that the car was ready, I knew otherwise but wanted to go up there to see if I could get my down payment refunded. When I asked about getting refunded my down payment I was told that your car is ready and that it was late in the day and they hadn’t time draw up the new documents. I knew they were not being honest because I had already spoken to the lender and told him the truth.

Mar 20, 2014: I called Elite Imports again to see if I could just get my down payment back and also some quite expensive test equipment that I had left in the vehicle when I initially dropped it off on March 3, 2014 for the repair (No response). As of this moment I’ve called and spoke with Derrick numerous times, he continues to pick up the phone and once he hears that it’s me I’m placed on hold for over 20 minutes, and no one returns to address my issue. But I’m going to keep trying!!!!
