eMarket411.com Illegally recorded phone conversation, set up an account lising online w/out consent, billed $399.00 Doral, Florida

Man with poor English skills called my son who has a County DBA statement on file. Man asked questions about the business etc., my son thought it was the recorder's office from our county. Did not really understand, and unfortunately he gave the information and agreed to things he did not comprehend by the language barrier. He received a bill for $399.00 for a year listing on eMarket411.com. The listing was full of misspelled words, fake pictures (not his business representation) wrong information about his business, etc. The phone calls began for collection of the amount they claim is due. If you want to cancel the listing, they ask for $199.00. I spoke to them and said he did not agree to this listing. Then they play a recording of the phone call, you can only hear mostly their side of the conversation. I questioned a part of the recording which proved to me my son did not think he was going to pay for any of this. Later I had them play it again for my husband, and they had edited out the part I questioned. I eventually sent them a copy of the California Penal Codes that make it illegal to record persons without their consent and then, to use the recording against them. If you are a victim check your state laws regarding phone call recording. A man called a few days later, and informed me they would take down the listing and would not bother us any further....since that was easier than the fine they would pay and the legal implications they were facing. If they have nailed you, check your state laws and send them an email with the information.  Good luck.
