Emusic.com Inc. Charged 12 year old daughter for services not requested and never obtained because she wanted to redeem her 50 free downloads card that she got with her MP3 Player for her Birthday! San Diego California

My daughter (12) received an MP3 player for her birthday which came with a card for 50 free downloads from emusic.com. She asked us if she could get these downloads from the web. I helped her and the website required her to sign up. After signing up, still she could not redeem the card because her account had to be verified with a credit card. She was a prepaid bank card from our bank so she put that number in to be verified. Then she saw that the selection was bad so she did not want to download anything. That was the end of it.

However, for three months they charged $19.99. After two months she was wondering why her allowance was getting eaten up.

I sent this company a correspondence through their website asking them to cancel that account and refund the money. They chargeda third time. I suspended my daughter's prepaid card (luckily) because they continued to try to charge the amount in December.

I calle them today and spoke with a Marie who said that the account was closed on December 8, 2008 and that she WOULD NOT refund the money although my daughter did not even use their services at all.

Additionally, she tried to say that I was lying. She said that to redeem those cards no subscriptions were necessary and that they check age when they the credit cards from their subscribers, which is not true.

I filed a dispute with my bank, but they can only annotate this occurrence.

Your 12 yr old was in violation of emusic.coms terms of service..from their website:

"THE SERVICE IS OFFERED AND MADE AVAILABLE ONLY TO USERS 18 YEARS OF AGE OR OLDER. IF YOU ARE NOT YET 18 YEARS OLD, PLEASE DISCONTINUE USING THE SERVICE IMMEDIATELY, OR IF, FOR ANY REASON, YOU DO NOT ACCEPT AND AGREE TO ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT, PLEASE DISCONTINUE THE REGISTRATION PROCESS AND DO NOT ACCESS OR USE THE SERVICE IN ANY MANNER"

Also, the 50 free downloads comes only with an enrollment into their service:

"For the avoidance of doubt, if you select an offer which includes free bonus downloads as part of your first paid subscription period, you will be charged upon registration and are responsible for paying fees for the Service as described in the preceding two sentences. "
