SUMMARY OF ARBITRATOR’S DECISION

Complainant Richard Ursetta (the “Complainant”) has challenged the truthfulness of certain specific statements (each, a “Statement”) posted by Author Anonymous (the “Author”) on the Ripoff Report website at www.ripoffreport.com as Ripoff Report #1218830 (the “Report”). The Author contended that the Complainant did not honor a warranty with respect to the Author’s purchase of energy efficient windows. The Complainant denies the assertions in the Report. The Author did not provide a response to this matter. Therefore, in accordance with the Ripoff Report VIP Arbitration Rules (the “Rules), the Author waived their right to participate in this Arbitration. By submitting a Report and a Complaint on the Ripoff Report websites, both the Complainant and the Author have agreed to submit the dispute to the Ripoff Report VIP Arbitration Program.

In accordance with the Rules, the Arbitrator was asked to decide whether the challenged Statements were an opinion or a fact. If, and only if, the Statement was determined to be a statement of fact, the Arbitrator was asked to further decided if, by a preponderance of the evidence, to determine if the Statement was true or false. If the statement identified by the Complainant is determined to be an opinion, no determination will be made as to that particular Statement because an opinion cannot be determined to be true nor false.

In this case, the Arbitrator had only the evidence submitted by the Complainant to consider. The evidence submitted included Ripoff Report #1218830, Complainant’s Arbitration Statement, Complainant’s Witness Statements, and supporting documentation.

Each Statement challenged by the Complainant has been considered, together with any Witness Statements and Documents provided by the Complainant for determination of the truth or falsity of the Statement. The Author did not provide a response to the Complaint.

The Arbitrator determined that the certain statements challenged in the Report were false. Therefore, according to the VIP Arbitration Rules, those statements have been redacted.

Warrant problems

This kinds of warranty problems are common. You cannot blame the vendor for it if the company has gone out of business! The vendor is a reseller, not manufacturer!

If you are buying a home, here are some inspection tips on most common faulty issues to look out for:

1. Faulty wiring. Worn or outdated systems and homeowner additions are the most common defects, especially in older homes. Electrical system problems are safety related and require immediate attention.

2. Roof problems. Improperly installed and aged surfaces occur frequently. We also see poorly installed or missing flashing at transition areas. Repairs may be simple or the entire roof may need to be replaced. Follow up any adverse roofing system findings with an evaluation by a competent roofer.

3. Heating/cooling system defects. Improper installations, inadequate maintenance and aged components are common.

4. Plumbing issues. The most common defects are leaking, outdated or problematic systems such as polybutelene. Repairs can often be made, but on occasion total system replacement is the only solution.

5. Inadequate insulation and ventilation in attic. Poor insulation and poor ventilation cause excessive utility costs and lack of occupant comfort.

6. Whole house is poorly maintained. Deferred maintenance represents a potential high cost situation to bring the home back into condition. If the homeowner did not properly care for the home, someone will need to later.

7. Poor drainage around the structure. Water needs to drain away from the structure at its perimeter to prevent water intrusion. Roof gutters and downspouts can sometimes be added to rectify site drainage problems.

8. Air and water penetrating cracks and window perimeters at exterior.Structure cracks and separations at the windows can allow water into the wall cavities, which is conducive to mold growth.

9. Minor structural damage. Cut and broken trusses are often seen in attic cavities and on occasion we also see structural components missing. Usually repairs are needed, however we find it is rarely an imminent safety hazard.

10. Potential environmental problems. Signs of mold growth represents the latest environmental scare. Homebuyers should consider a complete environmental evaluation of the property before buying.

Richard Ursetta is 100% Quality

I find it impossible to believe Richard Ursetta was crooked in his dealings. We had all 28 of our windows installed in 2012 by Comfort Windows including all triple pane windows in the front since we face the lovely west Texas. I have kept in touch with Mr. Ursetta ever since he took on the shortcomings of Comfort Windows when he was a

sales representative to open up Energy Window Solutions as the owner. He assured me if there ever was a problem he would honor the warranty even though it is not his responsibility. To this day Im still 100% pleased with our purchase and I continue to refer Mr. Ursetta to any homeowner because of this plus in addition to his

vast experience and knowledge to help th homeowner understand the importance of a great window as opposed to a builder grade window. Not to mention the far superior products he offers. We still talk on a regular basis and our house is still open to Mr. Ursetta to show to other potential clients which he has done.  This man has taken

personal responsibility to cover warranties for a window company that no longer exists and he never owned. And he has done so in order to maintain a good relationship with his clientele as well as doing it because his love and passion for windows and the money it saves all homeowners. The original post of this complaint needs to

understand he is getting Richard Ursetta confused with Richard Roeding who was the owner of  window company that were installed in his house. I hop this complaint gets removed because its bogus. Thanks!

 After receiving several recommendations from some of Richard's previous customers we had all of the windows, about 36, in our house replaced with triple pane glass from Richard's company, Energy Window Solutions.  The manufacturer is located locally in Fort Worth and this was a factor in our decision since we live in Flower Mound, TX.  We were so pleased with the quality of the windows, the workmanship, price, and attention to detail that we also had Richard replace our front door and sidelights.  We recommended Richard to others and one of our friends has also done business with Richard.  I can assure you that Richard is a man of honor and will honor his commitments and warranties, in fact, he will go above and beyond.

I am Rich Ursetta the owner of Energy Window Solutions and I have taken care of the Accent Window warranty issues for this customer at no charge.  Notice that the customer has also written me a letter of recommendation on this same report.

I used to work for Accent Windows as a sales rep but they went out of business thus there is no one to handle their warranty claims.  After Accent Windows went out of business I decided to start my own business Energy Window Solutions and partner with a local manufacturer so that I could insure that warranty issues on the windows I sale are supported and handled in a efficient and professional manner.  

The window manufacturer is responsible for warranty repairs and not their sales reps.  However, what is a homeowner to do when the manufacturer goes out of business.  Well, then the homeowner is stuck with paying for the repairs.

At Energy Window Solutions we want customers for life.  So even though Accent Windows is out of business, this customer was my customer so I wanted to make him happy.  Energy Window Solutions conducted the repairs to the windows at no charge to the homeowner.

To Whom It May Concern,

In September 2010 I purchased 18 windows for $17,450.00. from Richard Ursetta’s company (Accent Windows and Doors of Dallas).  At this time he was a local contractor with a Colorado company called Accent Windows Inc (AWI).  I received a lifetime and transferrable warranty on all of my windows from AWI.

Richard said that he will take care of my broken window because I was one of his customers, and he further promised that if I have any problems in the future that he will take care of them as well.  He is a man of his word, and definitely supports his customers after the sale has been completed.

These windows have made my home more comfortable in both winter and summer seasons, and have resulted in significantly reduced heating and cooling costs.

Doing business with a company is only as good as the people in the company, and Richard Ursetta is definitely a person you can do business with in confidence because he stands up for principles and is a man of integrity! 

I would highly recommend both Richard Ursetta and his windows technology.

Richard Ursetta of Energy Window Solutions is a trust worthy person and is very committed to after the sale customer support.  He has honored my warranty needs and has stated that he will be there if I encounter any other warranty needs in the future.  I would highly reccomend both Richard and his superior window technolgy - you will not go wrong doing business with Energy Window Solutions!

i am very surprised to see this complant against richard ursetta.

i have purchased windows from him and have needed warranty work.

here is what i have to say.

richard is a stand up guy.

purchased windows, 32 or 33, from him in 2011 when he was with comfort windows of america.

well, about a year ago there was an issue with 3 windows.

comfort was out of business, but i wqs able to contact richard.

i figured he would say since comfort was out of business i woas out of luck.

well, no problem.

richard sent someone out at NO CHARGE to replace the bad parts on the 3 windows.

thank you richard.

Richard called to say that he was an independent contractor for Accent Windows a company that was actually responsible for my lifetime warranty.  Accent Windows has subsequently gone out of business.  Richard said that he will take care of my broken window, and further stated that if I have any problems in the future that he will take care of them as well.  Doing business with a company is only as good as the people in the company, and Richard Ursetta is definitely a person you can do business with in confidence because he stands up for principles and is a man of integrity!

Received a call from Richard Ursetta Energy Window Solutions owner, previously the owner od Accent Windows and Doors of Dallas.

Richard emailed me to let me know that he will now perform a window replacement under the terms of the lifetime warranty.

I will update further after repairs have been completed.
