Let me start by saying this: I understand the concept of collection agencies. With any company when they want their money, they want their money. However, you catch bees with honey and not vinegar. There are people in this world who abuse the advantages they are given and at some point, they have to accept responsibility. And then, there are people who are tricked, bamboozled, victimized, etc. (whatever phrase you wish to use). You cannot treat everyone like a criminal! Onto my tale...


I'm a 35 year old single father of a 15 year old son and daughter. When I was 20, i got a girl pregnant, shotgun marriage, yada yada yada. My former wife passed away during the birth of our kids when when i was 27, I remarried for 2 years. About five years ago, I received a call from a collections agency referencing a debt related to a car loan. Since a few of my cars have been used jalopies, I was a little confused. I called the agency back to gain more information. After 15 minutes of being polite to this person who called me deadbeat and other non-intelligent names, I hung up the phone, but he did slip the original company's name. Upon calling them, they explained to me the car loan was taken out in 2005 at a Florida car dealership for a 2001 Jetta. 

Here's the biggie: the car loan was in my daughter's name...my 10 year old daughter. I explained to the rep that my daughter is a child and that its virtually impossible for a child to do this. The rep then asked if anyone had access to my daughter's information. I replied no and explained her mother passed away so I'm the only one with private information. She replied "Uh huh, well, I don't know, maybe you need to have a talk with your family." Really! I laughed and asked for the name of the lender of the loan. When I spoke with the bank, they provided the same information. Keep in mind, this is over days and I am still receiving daily calls from collections.  I asked the bank if they had any identification beyond a social. No. just the basics: address, social, mother's maiden name, date of birth. The DOB was March 2, 1979. 

I explained my story once more and this gentlemen was very understanding. He asked me to send birth documents to match with the social. I did by certified mail. Two months later, I received a letter of apology and advised to contact a lawyer. I went through the entire ID theft process. My lawyers sent multiple documents to the collection agency. I was informed about a fraud report for my daughter until 2016. There was an investigation that resulted in disappointment. Interestingly, the car was purchased with the loan, then sold privately to a family who totaled the 8 months before the collections company began to call. 

I figured all of this was solve but no....On September 13, 2010, my daughter gets a call on her cell phone from ERC about this same car loan. She hung up and I called the company back and explained my story again. They demanded for me to send a photo ID of my daughter along with SSN card and birth certificate. I refused and stated I would only send them the court documents from 2001. He responded, "That's not gonna stop us. Fraud laws have changed. She's under 18 then you're responsible." He demanded my information and I refused. He proceeded to laugh and stated, "I guess you'll be back in court soon you imbred loser"

Good job ERC! And yes, I have contacted a lawyer and get this, I was smart enough to record that call on my cell phone! I've been burned once!
