I was told that starting in the month of October, 2014, the Optional Roadside Assistance Plan will no longer be an option - but a condition of all vehicle rentals.

On September 25, 2014, while at Enterprise Rent-A-Car Company, I was informed that beginning in October, 2014, that Enterprise Rent-A-Car Company of Los Angeles, LLC, corporate office is imposing all rental customers to purchase the Optional Roadside Assistance Plan as a condition to renting a car.

California Section Code -1938 clearly states: "(K)(1) A rental car company shall not require purchase of a damage waiver, optional insurance, or another optional good or services.

(2) A rental company shall not engage in any unfair deciptive, or coercive conduct to induce a renter to purchase the damage waiver, optional insurance, or any optional good or service, including conduct such as, but not limited to, refusing to honor the renter's reservation, limiting the availability of vehicles, requiring a deposit, or debiting or blocking the renter's credit card for a sum equivalent to a deposit if the renter declines to purchase the damage waiver, optional insurance, or another optional good or service." And, although this has yet to happen; customers are being warned of this Roadside Assistance Plan as no longer an option but induced as a condition to renting a car.

Optional Roadside Assistance

Good Morning, Chris.

I apologize I hadn't seen your rebuttal before today. I am a local Enterprise Car Rental customer who resides in Lompoc, California, and a regular customer.

Today, as my husband went to pick up our reserved car rental, he was told by Mark, that he had to purchase the Optional Roadside Assistance Plan in order to complete the rental process.

Mark told my husband that the manager had stated the next time a car was rented, we had to purchase the Roadside Assistance Plan, no longer an option to decline.

Previously, my husband was also warned by the manager that corporate was inducing the purchase of the Optional Roadside Assistance Plan, and would no longer be an option to decline.

My husband contended with Mark and informed him, we had investigated this issue and found it to be a breach of the California Civic Code- 1938, in which provides detailed sections on car rental consumers rights on being forced into purchasing any "optional good or service."

Consequently, my husband declined the Optional Roadside Assistant Plan and was able to complete the car rental reservation.

But just so you are aware, this is what the branch manager is telling potential Enterprise Car Renters; they must purchase the Optional Roadside Assistance Plan to rent a car per corporate office.
