First, I'd like to thank each person who has reported this company, as it's made me realize that, although I suspected I was not the only one, now KNOW that this company has repeatedly and freely and openly violated consumer rights left and right.
I recently was served with a Notice of Default for the THIRD time as a direct result of Equity One. Inc, now known as Popular Mortgage Financing's repeated failure to post payments. This first happened back in March 2004. Although I was at the time less than 30 days late with one month's payment, I nievly assumed I was in the wrong, and when I called specifically to pay the remaining due immediatly (same day by western Union) I was told it was too late, that I was already in foreclosure.
This was about one week after they posted the notice, I now know that I had almost three months to pay that amount, and that further, the foreclosure fees they charged (in total just over $2,600.00 more than three times what was due) was entirely inappropriate as the amount posted was not accurate because they had not posted all my payments.
While I was on a payment plan to pay back the "fees" I received another foreclosure notice, indicating this time I was in default of more than $3,000. Not only was I fully paid up, I had paid additional fees of over $1,200 over and above the amount I had actually been behind on. And I had the checks from my bank to prove it.
I finally got angry, and demanded an accounting. I never (to this day) received one. I started paying by Western Union in December 2004 so I could prove (immediatly upon payment) that I had paid. I can show every check, and every western union payment I made in 2004 and 2005, when finally I served them a summons and complaint (almost a full year to the date of the second illegal foreclosure).
They finally got an attorney who agreed to correct my credit reporting, lower my Mortgage rate (marginally) and fix it for the remainder of the 30 year term.
A month after the agreement was signed, and the case was dismissed, I tried to refinance and get AWAY from the mortgage company, and was told that they had been reporting my payments late continuously for the last 8 months, including the month the agreement was signed. I have written confirmation from their attorney that they would correct my credit rating.
Three months after the settlement agreement I received a letter indicating that my "Adjustable rate mortgage" would adjust to a higher rate effective the following month. My mortgage is fixed.
In February of this year, I received a Notice of Default dated in January stating that I was five months in default for failure to pay since October 1, 2006 through January 31, 2007. In case you didnt catch that, October through January is only four months. I called the trustee and gave them the money transfer control numbers from my November, December, January and February payments.
I wrote three seperate latters disputing the amount and demanding validation of the debt from the "claiment". I sent eleven copies of each letter to Equity one, Popular Mortgage Servicing, the trustee, each of their Registered agents, and various parent companies (a total of 33 copies). Last week I received a Notice of Trustee Sale in the mail. Apparently they are unfased by evidence that their claim is wrong.
Clearly another law suit is in order. Please do not hesitate to contact me if you can testify as to their repeat and persistent failure to act with honor or integrity. A written declaration with document supporting your claim would be lovely. I am in the phone book, and my home number is listed in the white pages.
