ERC Collections ERC Keep calling despite letter telling them not to Jacksonville, Florida
*Consumer Comment: Next Step...
They were calling two or three times a day. About a week ago I sent them a letter telling them not to call anymore. They are still calling, however (in fact, they called just a few minutes ago.) What should I do next. Also, whenever they call, my caller ID says TOLL FREE NUMBER as the company's name. Can they legally do that?

I would suggest you first read up on the Fair Debt Collection Practices Act(FDCPA)
You will find that it is against the FDCPA to continue contacting you after you send them a Cease Communications Request. You can sue them if they even make one call after they received the letter. In court you can sue them for up to $1000 in Statutory Damages as well as any "real" costs. This is per company not per violation, so it really doesn't matter if it is 1 or 100 calls. The issue is that it is often better than to just have your word. So if you did not send the letter Certified Return Receipt Requested, or with some other method that requires a signature..that is the first thing to do. If they call you after they received it(other than to tell you that they are going to stop contacting you), you have a fairly easy case in Small Claims. If you already have proof then look into suing them now.
They can not misrepresent who they are. But "TOLL FREE NUMBER" sounds more like a limitation on your CallerID then them trying to "hide" their real ID.
