Ergopedic/John Lovett Ergopedic Sleep Systems Theft by deception, Non Delivery of Goods purchased,Avoiding our phone calls Irvine California

My wife and I were at the Utah State Fair Sept 2006 where we first met John Lovett (manufacturer's rep for Ergo-pedic Sleep Systems). We had planed on purchasing a competitors bed, but John convinced us that his product was superior and that they had the best customer service, so we placed an order with him. We were selling our house and had not closed yet so we could only purchase part of the bedroom set at that time. Because he didn't want to pack his display furniture up and haul it back to his home base (in Irvine Ca.) we were able to get some of the bedroom furniture at that time. We paid him at that time for what was picked up the last day of the fair.

When the funding came through for our house, we tried to call John and make sure that we would still be able to get the bed (a queen sized adjustable bed split in the middle so as to be adjustable for each of us) when we were finally able to reach him(January 2007) John said that it would be no problem, so we gave him our credit card information and he told us that the beds would be shipped immediately.

The beds never showed up. We waited for weeks and no beds and no contact from the company either. We called Johns phone number countless times and could only reach his voice mail. Most of the time his message box was full, so we couldn't even leave a message. However we did on numeous ocasions get through and did leave message after message.

Finally my wife was able to make contact with him and she was promised that the beds would be put on a truck right away and shipped out then. The last contact we had with Ergo-pedic was with their so called delivery driver who told us that he would not be able to bring it out on his next shipment. The driver was very curt on the phone and offered no explanation, only that we should talk to John.

It has been almost 9 months and we have not been able to make contact with him. We can't get a refund on the credit card, because our bank has a policy that wont allow them to refund after 2 months. So here we are , no bed and no money.

All attempts to contact John have failed and because of my health I'm not able to work and make up the difference for the loss of the $2500 that John Lovett took from us. We did find out that while all this was going on that John had purchased the Ergo-pedic bed company.

We contacted the State Fair people and reported this to them, and we were told that we were not the only ones to have had problems with these Shysters.
