On February 6th 2006 Erie Construction was walking around my neighborhood looking for customers. He came to my door asking if I would like to have my windows replaced. I went ahead and set up and appointment to have them stop by my house the following day to show me their windows. The next day, February 7th, two Erie Construction people, Chad Smith and Jeremy Miller, stopped by my house to show me their windows. They showed me how good they thought their windows were and how they are the best on the market and I believed them. They then went through the pricing of just 6 of my windows. They started out telling me that their normal price is over $14,000, but if I signed the night they were there, I could get them for $8,000. This puts very high pressure on someone. I normally look into every aspect of everything before I purchase anything, but they made it look like such a good deal.

I did try to check into it as much as I could while they were here and went to the Better Business Bureau site and every dispute was resolved. I went ahead and signed the contract knowing that I had 3 days to cancel so that I could look around. When he was going over the 3 day agreement with me, he said that all I had to do is call in within 3 days to cancel. I did some checking and found out that their price is over double that of other company's top of the line windows. Another guy told me how he knows of a crappy job they did and left a big mess for them to clean up. I went ahead and called to cancel within 16 hours because I was trying to be nice since they said that they were going to start putting hours and money into finding me a good loan and pulling materials. I called the company and told them I wanted to cancel. The lady I talked to didn't have any record of me anywhere. So she asked who I had talked to and then she forwarded me to Jeremy Miller. I told him that I wanted to cancel, and he right away got mad saying that they already put money into me. I apologized several times and told him I found better prices for high quality windows else where. I asked him if there was anything else that I needed to do and he said "no, I will take care of it." I apologized again and he said "yeah, bye."

At 10am on February 11th, just one day after the 3rd day to cancel, Chad Smith called to confirm my order. I told him that I called Jeremy to cancel and also faxed a written canalization over. I told him how I asked Jeremy if there was anything else that I needed to do and Jeremy said "no, I will take care of it." He apologized and said he did not know anything about it being canceled and that since I did not mail a notice to cancel in, that I did not legally cancel the agreement now. They either want me to pay 25% ($2,000) for canceling or they said they would give me a "deal" and take a $1,000 off taking it down to $7,000 and continued to tell me that this is only $150 above their cost. I wanted some time to think about this and ask around for some advice so I had him call me back two hours later.

When he called back I informed him that I was going to talk to my Lawyer on Monday and fill out a Better Business Bureau report. He said he was going to pass this off to their lawyers and put a lean on my property.

I was pressured, misled and lied to from this company. They told me that all I have to do is call with in 3 days to cancel. I call in the morning of the following day and Jeremy again assured me that there was nothing else that I needed to do to cancel this agreement. Three days later, Chad, his sales partner and boss, calls me and says he didn't know anything about this. They can charge however much they want for their work and products, but they need to be honest too.

I'm also an ex-employee of Erie. Everything the guy before said is true. There are 3 planned price drops. Their sales system is set up to sell after the 2nd drop.

Now, they don't REALLY even make their own windows. They buy all the parts to the windows and simply ASSEMBLE them at their "factory". The whole "factory direct" thing is a total scam.

Yes, their windows cost about twice as much as they should. They are a SALES company, NOT a construction company. Keep that in mind. The windows are decent, but that's meaningless here. There are plenty of other windows that are identical in quality for literally half the price. I'm talking half of what Erie's price is AFTER they've reduced it 3 times from their initial offer. Their racket is getting you to pay ridiculous prices by SELLING you, not providing quality products for your home.

As for the recision thing, that's also just smoke-and-mirrors. You can cancel your order after the legal 3 days and there won't be any issue...just a couple of aggressive salesmen lying to you and threatening you in an attempt to save their commision.

Better Business Bureau Response

On March 1st I received a letter from the Better Business Bureau informing me that Erie Construction stated that they have canceled my contract without a penalty. I'm very grateful that the BBB helped me with this, but still not satisfied with how Erie does business. I shouldn't have had to get help from an outside company to resolve issues with them. I'm sure that a lot of the other people out there that are put in similar situations don't know what to do, so they pay whatever needed to get Erie out of their hair. So I responded with the following;

I'm glad to hear that they are cancelling the order, but I've had no assurance that this won't happen to anyone else again. The only reason I wasn't forced into buying their windows or paying their cancellation fee was because I contacted you, the BBB. So for all of the people out there that have been put into my situation, or one similar, a lot of them are just going to end up paying because Erie makes them believe that they have no other option. When I checked out Erie's ratings on the BBB, it said that they are all resolved. This is also what one of the sales people pointed out to me. But I would not consider my case to be resolved until I have some assurance that they won't be continuing to do this to others. I've done some of my own research and I have found that this kind of thing is, by far, not uncommon with this company. If this company will not change its ways of business, I would like to extend their current bad reputation as a warning to others that have not dealt with them yet so that they won't have to in the future. I doubt that this is something the BBB can do, but I would like you to know that I am not satisfied with how Erie went about correcting this situation. I would like my case to be left at "Unresolved" if that's possible. I also believe that they should be red flagged on the BBB site.

First of all Erie construction sucks! all of there products are cheap and made in thier own factory. They also own they mortgage company so most of the home improvement loans are done through them, they have the hole system worked out!

The first step is marketing they have 200 canvassers that market the mid-west including FT. Wayne, toledo, dayton, akron, detroit, lansing, grand rapids, port huron, traverse city they cover the mid-west. The canvassers will work neighborhoods and convince homeowners to sign up for a no obligation free estimate with a factory rep which really means a sales demo with sales reps. The canvasser will usually tell you anything to sign up with them and its all lies usually, they never have special pricing or any huge savings etc. BE CAREFULL NOT TO SIGN THIER APPOINTMENT SHEETS, IT STATES THAT THEY CAN TELEMARKET YOU FOR TWO YEARS ON ANY FUTURE (FAKE) PROMOTIONS DUE TO THE DO NOT CALL LIST AND TRUST ME THEY WILL CALL YOU OVER AND OVER AND OVER!!!!

Next 1 or 2 sales reps will show up at your door with all equipment in hand to sell you their product that day! and they are trained to talk you out of any situation. The reps are also bullshitters as well they will usually try anything to get you to sign up, first they show you a retail price and then they have 3 price drops. So if anyone is reading this and they come to your door remember they will dropp there price 3 times!!!!

If you still do not respond to these prices they usually start to get angry and will sometimes use profanity, false advertisement etc. Hopefully you dont buy because their contractors suck even when working on employees houses as they recently screwed up an employees house and left crap everywhere, dented doors, left hole in wall etc.

As far as the 3 day cancellation, they will try to avoid you or yell at you or whatever it takes to make you feel like you cant cancell, dont be fooled just be persistent b***h them out if you have to!

Dont ever buy any Product from them they are not worth it......here are some average starting prices of their products........

Basement 25,000 soft wall system
Windows 700-1000 a window
Sunroom 15,000
Vinyl Deck 15,000
Cab. reface 4,000
Siding 15,000

these are just average prices not for actual use!

Cancellation need not take a particular form

I just received a link about the Construction disputes and the
Home Solicitation Act. http://www.fklaborlaw.com/construction-law/articles/const2.html "Notice of cancellation need not take a particular form and is sufficient if it indicates, by any form of written expression, the intention of the buyer not to be bound by the home solicitation sale." I faxed my written intention to cancel to Erie Construction on 2/8/06. He said that he didn't receive it, but I know that they did. The fax went through smoothly.
