On March 1, 2007 at 6:15 PM I was stopped in my car front of my apartment with my foot on brake (all rear lights working checked after the crash by the police) my son had just taken off his seatbelt had his hand on the door to exit the car.
In the rear view mirror I saw headlights of a car quickly approching my car it then slam into the rear of my car causing over $1,000.00 worth of damage. The car that hit me was totaled. The other car never even tried to brake.
18 year old Isabella Cecunjamin was the driver of the car that hit my car, my witness said she was not wearing a seatbelt. I brought a police officer to my witness and this officer never included her (the witnesses) statement in his report.
Officer Cody shower Ms. Cecunjamin's father that the window on her (mother's) car (which she was driving)was smashed from Ms. Cecunjamin's head hitting the windshield. In the statement given at the scene by Ms. Cecunjamin she stated, "I had my seatbelt on and it must have not been buckled all the way and came off in the crash." Either the car seatbelt is on or not--not buckled, not on! Ms. Cecunjamin said I had stopped without warning; I was parked when she hit my car. No tickets were issued; I was told by the police that they can't give a ticket unless they see the crash. So I'm wondering if the police are at every accident when crashes happen if that's the case.
The Cecunjamin's car insurance company is Erie Insurance they have not paid the claim as of today June 5, 2007. I have called Erie Insurance numerious times to find out why they have not issued a check to repair my car.
Erie Insurance has told me that Ms. Cecunjamin will not return a phone call to her own insurance company to give a statement about this accident. I had called Mr. Cecunjamin months ago to ask him to please, have his daughter give her statement to their insurance company, Erie Insurance. Mr. Cecunjamin said if it is her fault they will pay and has refused to contact Erie Insurance.
I have had to pay out of my pocket for my car to be towed to a garage. My car was stopped for a noisey muffler twice.(which was knocked off in the crash and broken) My son wired the muffler on but, it fell off again thus the second ticket.
Erie Insurance told me that under NY State law they (Cecunjamin's) have 90 days to contact Erie and make a statement. This law needs to be changed. It has now been 94 days and Erie Insurance has not paid the claim on this accident.
The Cecunjamin's have a new car and I wait!

Quit trying to get the insurance company to do anything. As long as they aren't completing the paperwork, the insurance company can't do anything.
Your problem is with the person who hit you - not the insurance company. A similar thing happened to me during 1976. As soon as the person who hit me was served with papers for small claims court in Plattsburgh, they couldn't complete the paperwork with their insurance company fast enough.
Sue them is small claims. Let them play with their insurance company all they want. You'll get your money - just sue them.

A few days after filing this report (update); 'Still Waiting'. I had spoken to Steven (his last name escapes me at the moment~~check my additon Report if you need to know that) had called me on a Friday at 5:30 PM to tell me to sue Isabella Cecunjamin's mother. Owner of the car the 18 year old was driving. I told Steven fine but, Erie Insurance had already made me wait for over 3 months to tell me this! Also let him know about this report I filed; told Steven he could go to the Ripoff Report and read it and that I will be calling the Better Business Bureau.
I received a call from Erie Insurance the following monday; and Erie Insurance sent me a check for the damage! Thanks so much to the Ripoff Report~don't think this claim would ever have been settled with out you!

"If the property damage of any person is $1,001 or more, all the involved drivers must file form MV-104 (Report of Motor Vehicle Accident). File form MV-104 with the DMV no more than 10 days after the accident. The DMV can suspend your driver license if you fail to report an accident."
I she did not file a report in a timly mannor, have her license suspended.

Hire an Attorney to deal with the Insurance Company

Hi, Sorry to hear of all your troubles dealing with an auto insurance company. Insurance is a business like the other party involved, only there to make money. This claim is unsettled to avoid an increase in premiums, that is why the restaurant owner will not respond and is hoping the "statute of limitations" will end before you try to sue them.
An attorney can help you settle this claim with the insurance company and possibly recover some money in "pain and suffering" for your medical bills in addition to your loss of property. The insurance company will pay no attention to a consumer because they know you have little if any legal knowledge. Most accident attorneys will help you without a fee until your claim is settled and recover their fee at that time as "contingency."
At least talk to a lawyer before you file a small claims case where you may not recover enough in damages to pay your medical bills or repair your car back to an acceptable condition. There is also limitations in small claims court, for example $2,000.00 is the maximum allowable in most states but check with your local courthouse for more information.
I am a Heavy Diesel Mechanic and study Business Administration at a Community College. Repairs to your car are expensive and the insurance company does not want to pay on your claim, this is why you keep getting so much opposition from them. After a predetermined amount of time (Statute of Limitation) you will no longer be able to file suit against them for this accident, you need to consult with a competent attorney as soon as possible regarding this auto accident.
If you ever need to deal with an insurance company, let them know that you plan to consult with an attorney, and then do it to protect your rights as a consumer. You may also write to your Attorney General to file a complaint against the insurance company for noncompliance regarding mandatory auto insurance and their opposition to settling your claim.
I certainly hope you are successful with this claim in recovering what is rightfully due to you in this unfortunate situation.

Now I'm told by their agent, Steven Walters, that I will need to take the Cecunjamin's to Small Claims court because they refused to contact Erie Insurance about the accident! I had wanted to do this months ago and Erie Insurance assured me this would be taken care of. I have been driving a damaged car for 96 days from an accident caused by Ms. Cecunjamin now after waiting over 3 months I will have to use my time to take the Cecunjamin's to court! The Cecunjamin's are owners of, 'Corvo Restauant' in Saranac Lake, NY and I had expected them to act correctly in this situation, in a business like manner.
