Ethos Group denied claim for blown engine despite proper maintenance and presence of lubrication prior to the event. "PREEXISTING OIL LEAK". 

I purchased my 05 Mini Cooper S just shy of 130k miles from Juan at AutoDirect in Parma, OH on 3/27/14 along with a dealer suggested warranty which covered the "engine and transmission" for 2 years. The vehicle was in good operating condition with no visible leaks or maintenance issues. 

On 5/9/14 I had Mini Cooper of Willoughby, OH complete an oil change. About 4 months after purchasing the vehicle, on 7/24/14 the oil light lit on my drive home from work, and within seconds the engine caught fire for several seconds. The oil poured out from the bottom of the engine due to a wrist pin shooting out of the block. I called Ethos Group, and they sent an inspector to look at the car. In conclusion, they denied my claim due to "a lack of lubrication" and a "preexisting oil leak".

As a follow up, I have since been in touch with the previous owner of the vehicle in which he provided me with records to indicate that proper maintenance was performed during the time of his ownership in its entirety. 

I believe, along with other certified mechanics who have since inspected the vehicle, that the reason there was no oil in the engine is because it was expelled from the engine at the time of failure. 

The warranty contract specifically states that, "...the cylinder block and head and all internal lubricated parts" will be covered. Exclusions include a "breakdown caused by improper types of or quantities of or contamination or lack of proper fuels, fluids...". Again, all maintenance procedures mentioned in the contract were abode: "...a minimum requirement on all oil and oil filter changes is every 6 months or 5,000 miles", which were completed within the terms of the contract. The oil change was completed at 132k miles.
