http://www.everbuying.com/ did not receive an item, been lied to, company agreed to refund but they never did Internet

I have paid for the phone. I have paid extra for expedited shipping. They have send me a DHL tracking number to track the item. DHL did not receive the item just the notification that this item will be sent. Their website states that I will get my item in maximum 12 days. Its 24 days now an DHL still did not receive the item to be sent. I demanded full refund and they agreed to it. But I never got it. All they are saying is that it is not their fault that it is the carrier fault, while they did not ship out anything at all. Excuses that are worth nothing, and its becoming clear to me that I was ripped off. All they are doing is delaying the obvious.
