Evo Merchant services inc EVO Direct The middle man between big banking and visa/mc discover & amex killing the small buisness man melville New York

We are a small business trying to keep up with the majority of consumers we except credit card.

Our credit card machine company EVO is the middle man for big banks and major credit card companies.

This company has been holding our funds for serveral months about 90 days because of 2 charge backs from our customers

The first customer was moving out of state and no longer needed our services. We understood when he did a charge back to his credit card company and EVO removed the funds from our account. No big deal normal practice. It became unual when they held an additional amount of $1797.62 this is the same amount that was already taken from our account and given to the customer.

Evo response to us about the additional money being held was the customer may change his mind and they have 4 months to do so, well if the customer changed his mind then they would owe us 1797.62. This was not reasonable and made no sence.

The second transaction was a charge back from our customer in the amount of $2941.32 she was upset because of a late deliver and when the delivery came she was satisfied with the product and stopped the charge back. Her bank SUNCOAST of NY was very helpful and debited EVO immiately.

Evo is also holding these funds in case the customer changes his mind in the next 4 months. They requested a written statement from our customer stating they would not do another charge back on this product the customer provided it. The Evo company still states they are holding all funds to protect themselves.

The bank stated they could no longer help us they have provided everything they could and didnt know what else would help. They were there for there customer not the merchant,  Visa and master card can not help me because Evo is their customer

I have reported this to the BBB of NY and Im waiting on responce. I have reported this to the Department of Justice attorney general of Nc

I have reported this to the New York statebanking, this was recommended from the attorney generals office of New York.

It is to bad we pay machine fees and pay % fees of all our credit card sales, And we are with no help at all when the middle man wants to jerk us around the customer cant help us, the bank cant help us, and the credit card company cant help us either. We are at the mercy of the middle man who is also a small buisness useing our money to stay afloat.

I personally want a stink about it. You can not help me on this but maybe bringing it to other mechants attention that EVO is not a reputable company will help them, not make the same mistake.
