SPAM vs. SCAM

Definitively controversial. Do we, as e-mail users have the right to privacy and not to get unwanted SPAM in our mailboxes? Absolutely. We all agree. Unfortunately, the recent over-regulation of the e-mail activity has allowed a new class of calamity: The e-mail SCAM.

There are many marketing companies around selling opt in lists to target clients. The bad part of this is that as A VICTIM OF THIS COMPANIES you never get to see the list. How would you know if the list is the right one? There is absolutely no way.

This is exactly what happened to me: I requested the service recently from Expedite Media Group. A so called "e-mail marketing companies" who literally ripped my money off. They sold me a very "specific" list of executives of franchises. Presidents and CEOs they said. They sent the campaign twice with ABSOLUTELY NO results. Yes, I was told they were "not responsible for any results" which is understandable, what is not understandable, (and this is why this practice is a scam), is that THEY SHOULD BE 100% responsible of providing you with the list you paid for. How do I know it was not the correct list? Because we often send mails to 20-40 member list, and in the worst scenario we get a 10% respond, that is 2 to 4 responses. IT IS ABSOLUTELY IMPOSSIBLE TO GET A 0% CTR OF A 2600 MEMBERS IF THE LIST WAS CORRECT.

My recommendation:
Do not hire EXPEDITE MEDIA GROUP.
WHAT IS HAPPENING NOW? Absolutely nothing. They hid like an ostrich. They do not answer my phone calls or e.mails. Again, dont hire these services or you will loose your money in a snap.

This consumer has posted and filed his groundless complaints everywhere he possibly can, in a desperate attempt to find a sympathetic venue. At first blush his claims seem reasonable, but open review of the contract and relevant documentation, it becomes clear that the consumer is merely engaged in a heavy handed attempt to steal our subscribers' data records and extort money from us to end his harassment. We are including herewith a copy of our response to his BBB complaint:

On 6/9/2008 we entered into a contract with the consumer to broadcast his message to approximately 2,600 email addresses, of persons who registered in our database as presidents, CEOs and owners of US franchises, for $500.00. (A copy of said signed contract is included herewith, for your review.)

Pursuant to Section 4.6 of the contract, the consumer acknowledged and agreed: there are no guarantees of success for any email marketing campaigns, that we shall not be liable for any unsuccessful email marketing campaigns and we did not guarantee any email marketing success or any results thereof. Furthermore, pursuant to Section 4.7 of the contract, the consumer also acknowledged all payments are due in advance of any marketing campaign or the setup of a hosting account and that [we maintain] a NO REFUND POLICY' for any marketing campaigns, once the account has been set up and approved for mass market.

The consumer was solely responsible for the message, reviewed it prior to broadcast and approved it, again acknowledging that we are not responsible for the success or failure of the marketing campaign and that no refund would be granted after it was broadcast.

On June 11, 2008 the consumer's message was broadcast. (Copies of the account records, including the messages broadcast, are included herewith for your review.) The records show the number of email messages that were transmitted, the number of broadcast messages that were opened by the recipient, the number of times a link in a broadcast message was clicked on or "clicked through" to the connected website and the number of opt out requests that were received in response to the broadcast message. (We have no way of tracking the number of people who actually visit a consumer's website, thus they track the number of times a link in one of its messages were clicked on. However, this is irrelevant in regard to the consumer's complaint, since we never made any promises that anyone would visit the website and, in fact, the contract expressly agrees to the opposite, as noted above.) The consumer was not satisfied with the results of his first message and complained. As a customer service courtesy only, we rebroadcast their message on June 16, 2008 at no additional charge. The consumer was again not satisfied.

We performed all our obligations under the contract fully and are not responsible for the consumer's defeated expectations. We did not guarantee any specific results and cannot accept responsibility in regard to the effectiveness of the consumer's message or the lack of interest in their product. These things are subject to the conditions of the market and other factors beyond our control.

Rather than accepting the reality of the consumer's rejection of his message and attempting to improve it, the consumer has engaged in a smear campaign against us in an overt attempt to try and extort $500.00 from us. (We are including herewith a number of the emails he has sent to us bragging about his antics and describing what more he intends to do if he is not paid.)
