These people improperly forclosed on my home and caused me to declair bankruptsy to keep my house. After bankruptsy they refused my payments and continued to do so until my lawyer contacted them. Then my house caught fire in Oct. 2003 and my insurence company sent the checks to fairbanks so they could sign off on them and send them to the contractors who were fixing my house and they kept the money for six months before releasing it. And I didn't even take my loan out with these people. The people I took the loan out with sold it to fairbanks.

I've been off line for a year and a half.....due to comp virus..however, the last I heard by mail from the attorney handling the class action in California..paper stated that Fairbanks owed me approximatly 2800.00 for settlement and wanted me to sign the papers and send them back well,I did not cause the amount wasn't right. This was Jan.2004. A few month ago I received a letter from SPS stating that they have settled with the class action and they only owed me: 5.33 in interest on my escrow acct.
My question is since when does the company being sued make the decision on how much they will pay to the homeowner. I thought the Judge appointed someone for this. I have been under forclosure for the last 6 years. Have you ever! They had to start the procedings over during this period which gave me the opportunity for another forclosure hearing..this is where you make your case with the local clerk. I handed the paralegal a 200 page file of this loan nightmare starting with Ocwen Federal, it has been on hold for over 2 years now. Last summer I checked with the office of special procedings and they informed me that it has been dismissed. I said, "Who dismissed it?" They told me the attorney for the mortgage co. Nowl if I were wrong in my claims why would they have done this? I agree that they will do all they can to try to steal someones home.
But I am not under forclosure now but when I do the home repairs on my home will they stary their stuff all over again. They will not win! I am committed to this on a daily basis.
