Fairbanks Capital aka Select Portfolio Servicing is a thief, liar and crook company.

I, like so many others i have read here, was a victim of the decietful and illegal practices of this company and barely saved my home of 17 years. When i got one month behind on my payment, I made arrangements to catch the payment up. However when I mailed the payment along with the current payment, both were returned because I didn;t include late fees. This started a ball rolling that ended up with Fairbanks taking my home.

Over the course of time with this company, I had fought illegal placement of insurance when I already had insurance, "lost" payments that cleared my bank, withdrawals from my bank account that had no relation to my payment and that they could not explain, "late" payments, though checks were mailes three weeks in advance and cleared my bank prior to my due dates... you name it, they did it.

I spent all last fall fighting to save my home when Fairbanks foreclosed after spending months refusing to accept "partial" payments and refusing to work out any sort of payment arrangements I could handle. They foreclosed in August, auctioned me off in September.
During this fight, I got a check for about 1/20th of the amount they owed me from the class action lawsuit.
Repeated attempts to get information on the sale and payoff amounts were met with statements like "we don;t have to talk to you", and "it's not your home any more, we don;t give out that information."

It took me until mid December, but I was able to find a company to refinance my home and pay it out of the foreclosure. My interest rate is sickening, and the payment is a real bite, but I have my home and in a year I will be able to improve the financing.

I raised my sons in this house as a single mom, and recently got re married and brought my new husband to live in our home together. He weathered all this with me and never wavered in his faith that we would be able to make it.

Fairbanks is in the business of only one thing- stealing the homes and very lives of homeowners.

We are still fighting & are going on to the Supreme Court in Washington. Why can't these people be stopped????

Now they are stating we did not opt out of the class action suit!!!! So,they say, we have NO right to our legal suit!!!

Can't something be done to get this out in the public again...can't we, victems, bombard the media & our officials to HELP US????

Someone suggested that maybe these conmpanies are just too big of contributers to our officials coffers for reelection.

At this point I would believe anything about them!!!!

There was someone on this site that said they took them to court & got their house back...if you can contact us for any help we would appreciate it ...BIG TIME!!!!

Fairbanks does NOT only take on sub prime loans

I bought my home in 2001, my mortgage company that I had, Fremont, sold my mortgage three months later to Fairbanks (my credit was good and no late payments). But, after getting involved with Fairbanks, payments were lost, fees were put on my mortgage that I didn't understand, etc. and I got behind b/c of that. Now, I am in bankruptcy trying to save this house. I sent my bankruptcy lawyer ALL of the reports from this site. We are going after them now. Good luck to all who have Fairbanks.

They succedded in Stealing ours

I am so glad you have your home. We do not have ours. It is unbelievable how lawyers can go into court and actually lie. You are sooo lucky & I will say a prayer for you.

As for the lady who takes responsibility and can keep up her credit history. I will say a prayer for heralso. I hope she never suffers from a catastrophic illness or accident. I hope that she never has her identity stolen nor sees her husband die of cancer in front of her eyes.

Credit histories can be come negative through outside uncontrollable forces. Pray you never fall victem to them.

Again to you who saved your home. Congratulations & godspeed.

After reading so many complaints It is my understanding that Fairbanks services sub-prime loans

It seems to me that most start out as "I was late one payment..." and "I sent two payments the next month..." It is my understanding that Fairbanks services sub-prime loans. Sub-prime means that the borrower has a history of late payments or defaulting. The borrower is subsequently charged higher interest rates. I've seen lamenting on these higher rates like the borrower thinks it's totally unfair that they are already "sub-prime" and being penalized for it. That's the way things are when you have shown by your past actions that you are more likely to default.

An example: I have absolutely excellent credit, NEVER ONCE been late on anything, house payment or credit. I recently had to have a credit card re-issued for security reasons. The payment was coming up on the old one, which had been cancelled, I didn't receive the new one so I didn't have a new number to pay online, and by the time I received a bill on the new one it was late. I called the credit card company to inform them that I hadn't received the card. They cancelled that one, sent a new one, and I also made a payment right then because now, even the bill I had was on another cancelled card. There was a $29 late fee on that bill that I had not disputed with them and hadn't even mentioned. I could have raised a big stink and pointed out all the reasons why I shouldn't have been billed that, I could have disputed it and caused endless problems but, I TAKE RESPONSIBILITY that I could have called them earlier because I knew the payment date was near and I hadn't made a payment.

I was pleasantly surprised to see on the next bill that I had been credited back that late fee. That's what happens when a company sees your history and believes that not getting the card/bill really was the reason it was late and not just another in a long string of late payments.

Home ownership may be the American dream but it is not a right.
