I have had a second mortgage through this company since the end of 2001. Since this time I have only received two statements and they also refuse to send me statements because of a bankruptcy that was discharged in early 2001.
At that time Nations Creditor was the original second mortgage company. After that discharge of my bankruptcy I always received my statements from Nations Creditor.
Ever since Fairbanks Capital Corp. took over the last statement I've received was July of year 2002. Listed on that statement were fees pertaining to an escrow account that is on my first mortgage, various charges for insurance that is not necessary do to the fact that my first mortgage already has coverage, also some other charges that I have the slightest clue to what they pertain to.
I've also had trouble contacting them for various questions about my mortgage with them and on how to my payment to them. Do to this I have had to make payments over the phone to them because I only have a P.O. Box address and they never receive the payment that way.
Do to this I get a charge of $15.00 every time I make my payment. And now I'm having trouble with a payment I made on July 8th of this year through U.S. Express Mail with a cashiers check. In which there was nobody from Fairbanks to sign for it. And the address I sent this cashiers check to I obtained on their website.
I have now received information that they have filed a motion for a relief from stay through the state of Pennsylvania. With this I now have more fees added to the balance of the mortgage.
I Just feel that Im getting the run around. Its effecting my credit, adding more to my balance, and causing more hassle in order to make a payment or even get a question answered.
I don't think this is any way to conduct their business and feel I might be getting ripped-off. I would appreciate it if anyone could reply to this with any information you can provide me with.

I had trouble with FairBanks to. I am the story from Coldwater. First you need to get on your state officials web sight. Contact your Attorney General for banking and finance. File a complaint with your attorney general.
File a complaint with the Fair Trade commission and file a complaint with HUD's Inspector General. Your attorney general should give you a number to contact someone with in FairBanks to see what can be done. If this does not help you call Terriell Smith he works for FairBanks and he helped me. He was very kind and understanding and took care of my issues I was having with FairBanks. His number is 1-801-293-2503. You will probably get his assistant tell her that you got the number from your attorney generals office dept. of banking and finance let her know that it is urgent you speak with Mr. Smith. What was a 4 month nightmare for me going through all kinds of people at FairBanks. Mr.Smith took care of everything in a matter of days.
I hope this helps you and I wish you and all of us the best and pray for all of us. Although I had my situation cleared up I still worry about what they might do next to me. Good luck
