Fairbanks Capital Corp ripoff very dishonest fradulent accused me of having been 14 months behind in payments, my account, sent proof I am not with cancelled checks, they still ignore Salt Lake City Utah

Fairbanks Capital Corp has set a date for foreclousure Oct 15th 2003 today is Oct.8th 2003 saying I was behind on my payments my accountant proved I made all payments . Fairbanks would hold my checks and charge me late fees also hold them so long and say tey never received them that I would go to the bank and send a cashiers check, then tyey would put the check through and charge me NSF. Also would say I did not have insurance and charge me triple the amount I had already paid.

At one point they forced me into Bankruptcy, then they put in a bogus amount I owed and the trustee paid it while I waas still making my monthly payments. This has become a nightmare I live with on a daily basis, I also became very sick due to the stress of dealing with this mess as well as run a business and maintain a home.

One last thing, I was sent back my ckecks without beind cashed randomly,with a letter sayiny we can't take your check you are in default, but they would take the next 10 checks, cash them and again randomly send one back to me. What else can I do?

Yet another victim of a scam artist company. Everbody says this can't happen to them if they make their payments on time but until it happens to somebody with some serious political power connections in Utah it will just keep going. Its the powerful elite in Salt Lake City that protects this company from the feds and the people that work there.

There's to much money to be made and so much ends up as contributions to the politicians on capital hill there in SLC that they aren't going to act to shut it down.

Before you send them another dime, consider what it will take to pay a really down-and-dirty, street fighting style attorney to scare off them and their dirt-bag foreclosure mill attorneys they make so much money for.

Patricia, sorry to hear about your Fairbanks troubles... join the club...

fax a "qualified letter of dispute" (yes, it should bear that title"... along w/ your supporting documentation to:

(801) 293-2555

That fax is directly into Fairbanks legal dept. & I have been receiving assistance in resolution via my dealings w/ the legal dept. BTW~ the legal dept. is the LAST TO KNOW @ Fairbanks when there is a problem, however they are the ONLY employee's w/ authority to correct problems. Lil catch 22 for the borrower....

Follow up the fax w/ a call to (801) 313-2173. This line goes directly to Greg Harmer, Fairbanks General Counsel's office. He will assign your case to one of his legal liaisons for resolution. In one month, w/ the assistance of the liaisons, I have gotten further than the previous 14 months of trying to deal w/ Fairbanks via customer service, foreclosure dept., etc.

Mr. Harmer has given his personal assurance that any case brought to the attention of his legal dept. will receive the attention it deserves... make him prove it & SAVE YOUR HOME.

NOTE** even AFTER you have confirmation from Fairbanks that the sale has been cancelled, be SURE to call your clerk of courts & assure that it has been done.

Contact your Attorney General's office, the Federal Trade Commission, and the Office of Financial and Regulatory Affairs TODAY!!!

Fairbanks can not foreclose on any property while the matter is being investigated through the Financial and Regulatory Affairs office. You will be assigned a case number and an agent that can expedite an investigation and halt the sale of the forclosure. If the loan is through Fannie Mae, contact them also. Also, call HUD (even if the property was not purchased as a HUD loan).
