Fairbanks Capital Mortgage, Select Portfolio Servicing, Emc changed billing address of my private homeowners insurance without my consent, then did not pay bill and at same time put into effect forced place hazarrd insurance Springfield Ohio

I have been a victim of fairbanks for 10 years. Before my first payment was due I received notice that I was late in payments. My loan had been with another company and it was transferred to fairbanks.

The company increased my monthly payments to almost triple the amount without notifying my self or the trustee. I am in a chapter 13 and they are constantly changing the amount of my payments. this is my second filing as my initial one was dismissed because fairbanks claimed I was 8000 dollars in arrears and my attorney at the time said he did not feel like driving to Pittsburgh the next day to attend the hearing and fight it and asked me to give him additional money to refile.

I told him I don't pay good money for bad service and then make the choice of doing it a second time. I hired a private attorney whose son happened to work in Utah at Fairbanks. He did manage to get a loan history which was impossible to interpret but by then my $2,500.00 retainer had run out and I could not afford to pay an attorney when fairbanks refused to answer questions or return calls.

I filed a second chapter 13 and at the adoption of the plan, without any prior notice, an attorney representing fairbanks said he was filing a second claim for 40,000 dollars additional. I objected but my attorney told me that they have powerful attorneys and it would cost me that much to fight it. I wanted my plan approved but figured I would deal with them later. this constant doubling and even tripling of my mortgage loan continued while in chapter 13.

They also changed the billing address of my homeowners insurance and also my taxes. they put into effect forced place insurance (for about the 19th time in the 10 years they have abused me as their victim and they also failed to pay my taxes in a timely manner. the property taxes that they claimed to have paid I had already paid.

my home was burglarized in 2004 and I lived 3 years without doors and windows as the homeowners insurance sent the check to fairbanks and they took that long to give me the requirements for a contractor and estimate that they required.

when i promptly returned the estimate it took them over a year to approve it and during that time materials went up as well as the contractor would only be allotted a certain amount for materials for each damaged item and then their adjuster had to come out and approve the work before the contractor got paid.

the contractor waited almost 6 months and then he told me he could not afford to wait for the remainder of the job to be finished. I called them in tears as my daughter and myself were both suffering from the effects of living like this and I in turn ended up taking a leave from work due to the mental and physical stress that this placed on me. I am still fighting these criminals.

I retired this week and my monthly pension check will be in the hands of these crooks except for 336 dollars which I am to raise a 16 year old child and my self on and still pay the utilities etc on my home which they have left me no alternative than to not be able to keep up with repairs. My roof is going to fall in very shortly. Between the bankruptcy attorneys in PA and fairbanks it is about as effective as spitting on a fish to try to stop the predatory deceptive practices I have been enduring for 10 years and suffering incredibly when I had no reason to be placed and left as a victim to these abusers.

I am glad to see that others did not roll over and die and are fighting these rapists. I pray that the attorney general and the trustee can recoup my money according to the ftc order of august of 07. It is also especially disheartening for me as a person who believed there was protection and justice in the court system when the 2 firms I hired both refused to do anything but collect their 2500 bucks and then advise me to let the case be dismissed.

They do not know that I do not live like that and I will seek the justice I deserve. I wish I had found this site sooner. but at least I am on it now and I will update you on the suffering and pain that I know will be imposed upon me with the courts permission.
