So we the people were finally heard and were told that Fairbanks Capital had been found guilty of fraudulent practices and that they were to reimburse and refund all the fraudelent charges they made against our mortgage loans. Yay, right? We won, right? Well, guess again.

Our loan was sold to another mortgage service provider called Wilshire Credit Corporation. They are now foreclosing on my property based on the information (incorrect) that Fairbanks gave them. When I sent them copies of all the legal paperwork and also sent copies of the claim forms submitted under the civil action suit, their totally nasty legal department informed me that they did not have to follow any of these court orders as these orders specifically listed Fairbanks Capital and they were not Fairbanks.

Their legal department (Routh, Crabtree Olsen, P.S.) informed me that they had every right to foreclose as they bought my loan from Fairbanks Capital in good faith.

Yes, I have filed a complaint against them with the Federal Trade Commission. I was told by the customer service there that although Wilshire may have said they bought my loan in good faith, that their company was very well aware of the pending lawsuit, and knew exactly what they were doing.

This has to stop. This selling of people's loans to one loan shark after another with each shark adding their own fees and extra charges. I was told by one lender that prefers to remain anonymous that these "servicing companies" such as Fairbanks, Wilshire, and Ocwen, actually make money foreclosing on people's homes -- even if they end up in a lawsuit and get sued.
I have been told the best thing for me to do is to refinance my home, but guess what? No one will refinance you if you have a foreclosure. Not only that, but the exorbitant payoff that is on my house after Fairbanks listed their fees, passed them on to Wilshire and then Wilshire added their fees, is higher than anyone is willing to loan me.

Is this the American Dream? Looks like a bunch of crooks have discovered a way to get rich quick by taking advantage of people wanting their own home.
Sure, we won with Fairbanks, but they just passed the buck to other loan sharks out there.
