We have been with FCCC since Aug 2004 - a few glitches along the way, but a wonderful Customer Service rep named Lynette (Thank you LYnette if you're out there), that fixed many an oops. Now FCCC is out of business or acquired by American Debt Counseling, Inc (conflicting reports of out of business or acquisition). Our Sept payment of $1326 was taken but never forwarded to our creditor. I have filed reports with the attorney general in Florida, as well as my home state's attorney general. I have also forwarded a complaint to FCCC attorney, who was one who responded to a previous complaint. I have also filed complaints with the Florida BBB.

I suggest everyone do the same. Watch your credit card statements...good luck.

I am out $1326, but others are out even more.

Another suggestion is to contact your banking institution and see if able to file a charge back or other complaint on the ACH done by FCCC. SIGH!

SOmeone is out there taking a nice vacation on my hard-earned money.

I have been a customer of FCCC since Sept 2004, with several bumps along the way. With persistent contacts to them, and vigilant monitoring of my credit cards statements, I was able to resolve their slow or no payment. But now they have closed their doors. So how did I get my money back?

Go to your bank ASAP (as some banks have a time limit) and file a dispute as to the ACH withdrawn by FCCC. Basically you are stating that you authorized FCCC to take the ACH but did not deliver services and they have now closed their doors. Be sure to bring any documentation you have...ie your original signed contract with CDME, FCCC ( or whatever name they used at the time), a copy of the letters (I recieved 2) from ADC stating ADC now services, copies of your notarized compaint with the Florida Attorney General's office (file one if you have not already) and correpondence or emails attempting to contact FCCC.

The bank will then credit your account with the funds. Note that some banks return this as a provisional or temporary credit. Each bank has slightly different rules. They will attempt to contact FCCC or allow them a certain number of days to respond.

I got my money back! Hope this helps you as well!

I got $ back through my bank

Go to your bank RIGHT NOW and file a dispute on the ACH. Bring all documentation you have, ie your original contract with CDME, any correpondence, letters from FCCC stating ADC was taking over, letters from your creditor stating payment not received and copies of your attempts to contact. I stated that I authorized the ACH but FCCC did not deliver services. My bank returned the funds from the October payment to my account the same day I filed the complaint. NOTE: some banks do a provisional return of funds and allow FCCC time to respond. I highly doubt FCCC could respond (or will for that matter) with anything in their favor....good luck! Get to your bank ASAP!!

Update on the atty general complaints: SD Atty General has sent a letter and FCCC has 20 days to respond. The FL Attorney Gen office sent me an affidavit to complete, have notarized and sent in.

The same thing happened to me. For $820 my Sept/Oct payment was never received by my credit cards, but it was debited from my account.

Just curious what their lawyer said? And how is it going with your Attorney General. Do you think you will get any of your money back.

Will you care to share the lawyer information with me.

I have FCCC atty's contact info from previous Atty gen complaint

10-28-08 I have proceeded to re-open my complaint with the SD attorney general's office (my home state). Through my previous complaint with the attorney general's office, I do have FCCC's attorney contact info. Hopefully he will do the right thing and get all of us our money back or at the least get FCCC to forward all the funds to the creditors in accordance with the servicing agreement.

I encourage everyone to file complaints with the FL attorney general's office and your own state's attorney general's office.
