This is the letter I sent to the Texas State Board of Insurance which does not do any investagating either to help the public.
June 2, 2007

My Complaint is as follows:

My Insurance Company will not pay for my claim of my 2005 dodge SRT4 and we willingly gave up all information on the incident to the best of our knowledge. Also through out this claim process we were not informed at any time as to what was going on with my claim except that it was under investigation which was said to us that an investigation was normal procedures.

To this day we do not know if the car is totaled or would have been fixable or what the damage would have cost. The car was never taken to a facility by the insurance company, if it was fixable and it is still in my driveway where the 2 occurrences happened.

This is a $23,000 car and still having to make $472 a month payments even thou it is not drivable. Also they still have no problem taking my $436 insurance monthly payment out of my acct. on automatic payment!


Circumstance leading to claim:

On Fri. March 30th 2007, during the AM early hours the Dodge SRT4 that set in are driveway closest to the street had been vandalized. Robert Sr.

Came home from work that morning at around 8:00 AM. I ( Tina) was up getting ready to go to work went in Kitchen when Robert Sr. came in house one of us opened the blinds at the kitchen window which faces out to driveway, Robert looked out and said there was something wrong with the windshield of the Dodge SRT4. so he went out side to look at the car he looked through a hole in the windshield and seen it had been on fire so he yelled at me to call the Sheriff, which was about 8:10 AM, so I did and they got there at about 8:20 AM. They had their other sheriffs come which was crime scene, then arson and did their investigation till around 1:00 PM. Robert Sr. then called me at work to call the insurance company which I did at that time. Insurance investigator (Jeff Abram) called me (Tina) on Tue.

April 3rd 2007, at around 9:00AM and said he would be there in an hour which Robert Sr. and I (Tina) was on our way to do an install for work at Cypress, but I told Jeff I would be there, well we waited for him in about an hour he called again and said it would probably be another hour. We were supposed to be in Cypress at 11:30AM and we were already going to be late so we had to leave so my son, Robert Jr., was home and we told him to give the keys to Jeff when he got there. Jeff did his investigation and left.

On Apr. 7, 2007 at around 3:00AM (Robert Sr. was at work) Robert Jr. and I (Tina) was in bed and Robert Jr. came in and woke me up and said the horn was going off on the Dodge SRT 4, so I got up and we went out on the back porch to look and I stood there while Robert Jr. went to car to see what was going on ( there was a distinct odor in the air that smelled like electrical burning) Robert Jr. opened the driver door to find it had been on fire again and that was why horn was blowing because the dash and steering wheel had burnt.

So he pulled the hood latch to open and unhook battery to stop the horn, during this time the neighbor down the street heard the horn also and smelled the electrical smell and drove down to stop in front of driveway and ask Robert Jr. if he belonged there and I was still standing on porch and yelled to him it was ok I was there so he went back home.

On Mon. April 9th 2007, I called Marie Felegi our adjuster to let her know about the 2nd fire and she kind of laughed and said ok she would let Jeff Abram their investigator know. I talked to Marie Felegi again after she talked to Jeff and she said Jeff told her that it was a separate incident that the first fire could not cause the 2nd so I told her that, that was not true that it smelled and looked like it shorted out and burned so I told her she needed to send him back out.

Jeff Abram came back out on Apr.17th 2007, to look again, Robert Sr. and I (Tina) was there and watched him investigate the car. I ask him if it had been electrical that caused it because nobody that investigated early had said to disconnect the battery. Jeff said it did not look like electrical to him because of burn patterns, and I told him I dont know how when it smelled like an electrical fire still that day.

So Jeff said he would look at his earlier pictures and compare. At that point I felt if he thought it was set on fire again that he should of told us to call the sheriff again to reinvestigate before any evidence was touched by him, but he did not, he took his own samples and left., (also received a certified letter from insurance that day letting Robert Sr. and I (Tina) to go to an examinations under oath on Wed. April 25th 2007).

So I took it on myself to call Sgt. Danny --- (Galveston co. arson) to look at the car again for a 2nd opinion. Sgt. Danny --- called me and said he would come on Tuesday, April 24th 2007. We had an install on Tuesday April 24th so we unlocked the car that morning so Sgt. Danny--- would be able to look at it.

While Robert Sr. and I (Tina), Robert Jr. was on install Sgt. Danny--- called and said he was going over to look and I told him we were not there and I unlocked the car for him, he asked me, do you give me permission to go and look at car when I was not there I said yes, so when he got there he called me again and said it did smell like an electric fire to him, but he would look and compare to his other pictures and ask for the insurance investigators name and how to get a hold of him so he could ask him why he thought it was set on fire again. So I gave him that info and he said he would call me back, I called him a couple of times and left a message He never got back with me.

On April 12th 2007, I (Tina) went to Farmers Claim office in Sugar land to meet with Marie Felegi and to sign papers she said I had to sign because she said she had overnighted them previously, but I never received them. She also told me that she would call me Fri. April 13th 2007 at 11:00 am for a recording of what happened and we would also have to submit to an examination under oath which she said that it was standard procedure. She did not call me until 4:30 pm while I was driving for this recording. I went ahead and made the recording

On April 17th 2007, we received a certified letter For Tina and Robert M. to appear for Examination under Oath and what to bring with us on April 25th 2007 at 9:30am in Houston.

Still do not know anything about what is going on about the car!

On April 25th, 2007 we went to examination in Houston, Vickie Craft (attorney) told us to come back to her office, she told us to go home it was canceled to day because they also want to talk to Robert Jr. too. Which no one had said anything about him prier to this. Vickie said she would send a fax to let us know when and where we would meet again. Got fax that afternoon saying Rescheduled for Monday April 30th 2007 Beginning with Robert Sr. at 1:00, Robert Jr. at 2:30 and Tina at 3:30 in Dickinson TX.

On Monday April 30th 2007 at 1:00 pm when we got to the examination, Vickie changed the order of us in the examination of what was faxed to us in the letter, she said that was a clerical err, she wanted Robert Jr. first which she kept him in there from 1:00PM to 3:30PM, then Robert Sr. 3:30PM to 5:30PM, Then me from 5:30 PM to 6:30PM. We answered all her questions to the best of our knowledge.

We took her all the information on her list she asked for, but she did not ask to see it all, we asked her if she wanted to look at the rest of the stuff she ask for, she said I guess what else do you have. Also during Robert Jr. and my (Tina) examination Vickies cell phone rang and she answered it which I felt was wrong since we had to take off our work and had the curt to turn ours off for this.

She then ask me (Tina) to send her the phone # of the neighbor that had come down during the 2nd fire, all of cell and house phone records for me (Tina), Robert Sr., Robert Jr. and the name of our last renters in our rent trailer that we evicted and said we would hear something in about 10 to 15 days. Thursday May 3rd 2007, I faxed that info to her, also giving her a curtsey call, leaving a message that I was faxing them the info now.

Did not receive any information as of May 24th 2007, so I (Tina) called Marie Felegi to find out any info, she told me it was out of their hands and in the attorney and to call Vickie Crafts office for information. So I called Robert Sr. and told him, so he called Vickie and she answered he ask why we have not heard anything and why it is taking so long for her report she said she was sorry and she had problems, Robert ask her if she was having problems how come she did not call us, she then said that she was faxing the report to Marie right now as they spoke.

On Tuesday May 29th 2007 Robert Sr. called Marie Felegi office at 4:00PM sense we have still not heard anything and she was on vacation talked to her supervisor (Darwin) and he said we were getting a letter and that they were not paying the claim. The letter came certified on wed. May 30th 2007 and it said they was not paying for the claim which we still dont know if the car is fixable or not. (Copy of letter enclosed)

We feel that we did everything they ask us to do and we gave them all the information that we could to the best of our knowledge.

We feel we have been harassed unjustly and feel like they are accusing us as being guilty, and from what Sgt. Danny---said from the start even the sheriffs do not have any leads. We have had Farmers for our insurance for the last 12 years on auto and home and I feel they have been very rude to us through out this whole ordeal. We have also just found out that there was a supposed arson person they suspected to be setting fires around our naborhood at around that same time frame but had no evidence.
