I was interested in purchasing a used Audi S5 and found this car on ebay. I then reached out to the dealer through their website and made an offer. We settled on a price of $31,500 plus $395 document prep fee for a total of $31,896.

I was sent the paperwork via email with their signatures and I signed all the papers and emailed them back. On 6/15/2015 I wired $31,896 to the dealership's bank. I then proceeded to arrange for a shipping company to pick up the car and bring it to me. I paid the broker for the shipping company a $175 deposit and then waited for them to find a shipper.

The broker arranged to have the car picked up on a particular date and the shipper showed up at the dealership, but nobody was there.

I tried numerous times to get somebody on the phone but couldn't get anyone to respond. I ended up getting one of the owners (Steven Birdsong) of the dealership on the phone and he apologized for the issue and said that he would pay to have his shipper send the car out to me in a couple of days.

Days went by and no car and no response from the dealer. I called dozens of times with no response. I finally got a text from Mr. Birdsong that the car was never owned by the dealership and that the owner of the car had traded it in for something else. The dealership never informed me that the car was on consignment.

At this point I asked Mr. Birdsong for my money back plus the $175 that I lost on the shipping deposit, plus the $25 wire fee that I paid. He agreed. It took a very long time, but I finally got most of the money wired into my account ($31,650). He promised to send the rest but never did.

He still owes me $446 not counting interest, but refuses to answer his phone or texts.

This was a blatant case of fraud by selling me a car and taking my money when the car wasn't actually for sale.
