Due to unforseen circumstances, I found myself in need of fast cash. I had receive received several "approval letters" from fastcash.com, and filled out the online application. It implied that the loan would be due and ach debited to my checking acount in 14 days. I received n o notice that my loan was approved, and was surprised that it was added to my checking account. Well, In 14 days my account was debited $90.00, and since I had no way to know what the plan was, I thought that they must be taking it out in installments.

I didn't want to do that. When I went online to complete the payment so that it would be done, I could not locate fastcash.com site that I had used before.

I checked my bank statement and there was no number listed with the withdrawal. I was not aware that fastcash and payday-yes were the same company. After having 845 dollars debited from my account, I asked my bank to find some contact information so I could stop this. I got the number of their bank, who gave me the phone number for payday yes. The nasty lady on the phone explained that I had been given 3 options, sent after much more nastiness, a "copy" of the loan agreement, which I had never seen, which explained basically that every 2 weeks they were taking $90 service fee 6 times, then taking the service fee plus 50 dollars toward the debt.

Can anything be done? I am not usually this naive and suseptible to ripoffs. Is there any recourse?

How to fight back against Fastcash loans!

First off, close your account. Never trust any payday loan place. Send the money back to any payday loan place that has not signed a contract, or forwarded you a copy. Although they have taken so much from you, try and find others who have been ripped off, by placing ads in the "community" listings of Craigslist, or a newspaper. Never allow more debits than what you owe. lose your account, and pay them by money order. Do not give them your debit account, or they will go back in, and finish you off! You must fight this way, even if they threaten you legally. You can do more harm, cost them more money in a lawsuit, than it is worth to them, especially if you file a class action with other people. They even deny your right to do so in their rotten contracts! They say you cannot file a class action, but you can, as they committed fraud against you! Don't be afraid of a little bad credit, as the whole world looks down on these loan sharks! Go forward with the truth on your side.

Like the author, I found myself in the deadly grip of payday loans and with little hope of paying them off I turned to a law firm for help. They have been OK so far, although it has cost money to used them as well. I've learned a lot since then and I want to share a few of my observations with anyone who may have need to listen.

First of all, if you need money and are considering taking out a payday loan, DON'T DO IT! I'm serious, no matter how bad your situation may seem or how badly you need the money, payday loans are the worst possible solution. Sell anything of value, get a second (or third, or fourth) job, sell your plasma, eat dog food. etc...but stay away from these loans. They should be banned outright.

But, if you have taken that plunge already, allow me to share my thoughts.

(1) In many states, payday loans are ILLEGAL due to the extraordinarily high interest rates that they charge. That means even though you "signed" a contract and agreed to pay them (ie $90 every 2 weeks for a $300 loan, plus the principal) it is still an invalid contract that they cannot enforce. I simply quit paying them and in spite of the nasty phone calls nothing else has happened.
(2) I found out that even lowly debtors like me have rights after all. The fair credit reporting act is very simple and straightforward, and the restrictions on collection efforts apply to payday lenders as well as credit card companies. They can't call you before 8 am or after 9 pm. That is the law. I was able to put an end to the harassing phone calls and to phone calls at work by sending them a certified letter formally asking them to stop calling me. It worked, although you have to be patient and don't allow them to intimidate you. If your request is in writing and the mail was certified, they have to comply.
(3) The first thing I did to gain control of my situation was to go to my bank and I closed the account that they were bleeding dry and opened another account. That put an end to the $90 deductions every payday.
(4) You can use a lawyer to help you, or you can do it yourself, but it has been my experience that they are agreeable to a settlement offer in the end. Something is always more than nothing. I won't give out the details but I settled several of them for less than 1/3 of the original loan amount. You need to be assertive and firm, however, without being rude or obnoxious.
(5) Be honest with yourself and do whatever you have to do to make sure you never go to these people again. Borrowing money is almost always a bad idea and payday loans are absolutely toxic. Stay far, far away from them for the rest of your life.

I HAVE SOME SUGGESTIONS FOR YOU

I ALSO HAVE BEEN HAVING PROBLEMS WITH PAYDAY YES, THEY DID NOT SEND ME ANY INFORMATION OR A CONTRACT WHICH THEY MUST DO. I HAVE FILED A COMPLAINT WITH THE FEDERAL TRADE COMMISSION AND THE DEPARTMENT OF FINANCIAL INSTITUTIONS FOR MY STATE, IWOULD SUGGEST YOU DO THE SAME, THIS IS THE ONLY WAY THEY WILL BE STOPPED. THEY HAVE BEEN CALLING MY WORK AND THREATENING TO GARNISH AND WHEN I TELL THEM NOT TO CALL MY WORK UNDER THE FAIR DEBT COLLECTION ACT, I WAS TOLD THEY ARE A FIRST PARTY LENDER AND IT DOES NOT APPLY TO THEM. THESE PEOPLE ARE VIOLATING EVERY LAW KNOWINGLY AND MUST BE STOPPED SO THE ONLY WAY IS THROUGH OUR COMPLAINTS TO THE PROPER AUTHORITIES.

Did you get the 300 dollars??

Find it hard to beleive that you got a loan for 300 and didn't know it was approved when you got the money (you didn't state anywhere you didn't get the money).

The terms would have to be available to you at some time during the transaction and you would have had to accept or deny the terms (or did you just click accept)??
You can check with the state attorneys office and see if you can press charges for usury dependent upon the circumstances this may not be an option but you should check into the laws of your state as to what kind of interest can be charged for what kind of loans (some higher risk loans have higher interest but they cannot exceed a certain percentage). These hard luck loan places count on people with bad credit because they can charge them a higher rate.
