Avoid doing business with these crooks at all costs. Fastcolorprinter.com failed to refund $742 spent on credit card pending approval of "no obligation" "Free Artwork Check". I did not approve, the work was never put in their production cue, yet they shamelessly refuse to refund using a contorted reading of the cancellation policy found under their terms and conditions. The policy clearly refers to cancelled works in their production cue, not works in the "no obligation, Free Artwork Check" cue.

To whom it may concern,
Because my bank first erroneously framed the chargeback as a duplicate charge, then, in a second challenge, claimed not to have received a dozen pages faxed in support of the claim, my bank has offered to reopen the case.
Fastcolorprinter.com "Free Artwork Check" clearly states:
"Once we've done that, we'll email you back with a proof, or with instructions on how to make any corrections if he can't make them himself for you.This service is absolutely FREE and you are under no obligation or order or buy anything from us."
4 credit card transaction made on 20 May 2011 pending "Free Artwork Check"
2 approved "Free Artwork Checks": A and D.
2 "no obligation" "Free Artwork Checks" not approved:
B disapproved on 20 May 2011 2:45pm.
C disapproved on 20 May 2011 2:47pm.
Not given "ok to print" therefore fastcolorprinter.com did not "move these into production!" as Fastcolorprinter.com stated in solicitation of proof: "Please make sure all content is correct. If you approve, all we need is your "ok to print" and order to move these into production"
Fastcolorprinter.com did not get approval on artwork checks B and C, as clearly stated above, did not get an "ok to print" "and..." therefore no "...order to move these into production"
Fastcolorprinter.com, in their response, makes the unsubstantiated claim: "On Monday May 23rd, Mr. O called and informed us that he wanted to cancel the other two orders he had pending."
"pending" legally defined as: Begun, but not yet completed; during; before the conclusion of; prior to the completion of; unsettled; in the process of adjustment.
Pending "Free Artwork Check", an order has not been established. Artwork check states: "This service is absolutely FREE and you are under no obligation or order or buy anything from us."
Fastcolorprinter.com order confirmation for files B and C falsely and in contradiction to uncontested fact of non approval of B and C states "Files: Already Checked":

Order confirmation falsely describes files as "Already Checked". Credit card transaction occurred prior to Files being checked and approved.
Fastcolorprinter.com goes on to state in their response:
"As we can see through the meticulous separation of orders by Mr. O that the orders he places were, in fact, individual orders and not multiple charges in error by our establishment as he claimed. Each order was placed individually by him on his computer as seen by the i.p. address indicated on each order and he labeled each order as "A" "B" "C" and "D" in the special art intructions. Additionally, for each order to process, he agreed to the terms and conditions. We printed and shipped the orders that he approved and did not ship the orders that he disapproved. We proofed the art that he sent for the all of the orders and since we had done the graphics portion and he was canceling the orders after the close of business day on the day the orders were placed, we are standing by the cancellation policy in our terms and conditions stating "No refunds will be given for orders cancelled after 8pm of the same business day the order was placed."
I do not contest making individual orders pending the "no obligation" "Free Artwork Check" Rather I contest the bait and switch regarding the promised "Free Artwork Check" I demand just recompense in the form of the refund promised in the following emails; the first email mistakenly refers to me as "Olaf" the second makes the correction:

I checked with my manager and we can lower the fee to $35 per order.
As you understand, I am just following the terms and conditions.
I know you are a new customer and I, also representing Fast Color Printer--do not want to misrepresent who we are and the integrity we carry. Please accept my sincere apologies for any misunderstandings. We do file checks for everyone, absolutely free every time. Even if you approved your proofs, you are not obliged to order at any means. That's why I asked that you wait to view proofs first prior to placing the orders.
I enjoyed assisting you and definitely would want to see you as a returning customer. Going forward, we can refund you and deduct $70 total, or we can use it as a full credit on your next order. Please let me know your decision.

The "graphics portion" Fastcolorprinter.com claims they "had done" was in fact an unapproved "no obligation" "Free Artwork Check" Fastcolorprinter.com omits from their record, that they gave me the option of a refund or a credit. I chose the refund. Proof B and C "Free Artwork Checks" were rejected and therefore were never ordered. The credit card transactions were made on May 20th 2011, the "Free Artwork Check" was disapproved and sale cancelled before the end of the business day May 20th 2011.

As a small business owner, artist, of limited means, father of a 4 1/2 year old son, 8 month old daughter, I can say Fastcolorprinter.com's not honoring it's "no obligation... Free Artwork Check" has been personally devastating. In spite of false claims of a "Free Artwork Check" and a promised refund; "Going forward, we can refund you and deduct $70 total" Fastcolorprinter.com has wrongfully withheld $742 for over 2 months. If my bank fails to address this, I'm left with an overdrawn account and no other recourse than to take fastcolorprinter.com to small claims court (1350 miles from where I live)
After spending $600 for services rendered I never imagined the uncommitted $742 would be held in spite of the clear "no obligation, Free Artwork Check" claim on their site. Fastcolorprinter.com's terms and conditions regarding cancellation clearly refer to post proof "Free Artwork Check" approval. Fastcolorprinter.com's "no obligation, Free Artwork Check" gave me confidence my money would be safe pending the "Free Artwork Check". Fastcolorprinter.com is heartless, dishonest, and predatory in every regard. This case is far from closed.
