Fayette Vision Did not supply contacts ordered and paid for ripoff Fayetteville Georgia

I ordered a six month supply of contacts on 12-27-06 and was told the contacts would arrive in 7-10 days. Upon the 10th day, I called Fayette Vision to see if the contacts had arrived. I was then told it would be 2-4 weeks because of the strength of the prescription. During this time, my check for $158.00 that I wrote out to Fayette Vision to order my contacts was processed on 1-2-07.

I again contacted Fayette Vision to see when the contacts would arrive and was told they were on back order and would be 4 - 6 weeks before they came in. This is now the end of January, first part of February and I was now having to wear my glasses (which I don't have as good of peripherial vision as I do with contacts).

I ordered a set of contacts through 1-800-Contacts as they had my prescription in stock and received them within 1 weeks time and $20.00 cheaper than through Fayette Vision. I again contacted Fayette Vision and requested a refund as we were now into March and still no contacts and I had to go elsewhere to purchase my contacts. I was informed the contacts were on back order from the Vendor until May and it was against store policy to issue a refund and I would have to wait until my contacts came in.

On May 2, I tried to contact Fayette Vision and discovered their phone had been disconnected. I contacted the business next door and was told Fayette Vision had closed down 2 weeks prior. I then contacted the Fayetteville Business License office and was sent the information from the Secretary of State's office detailing business owner and company information and also discovered someone had called the week prior to report the same issue with this company. The business license listed D & C Holdings Inc. (namely Dena and Christopher McNamee) as the registered owner of the company.

I then looked them up on the internet and tried calling the telephone numbers provided for them and they too were disconnected. I then contacted the Fayetteville Police Department to see if they could provide assistance on what I could do. They referred me to the Magistrate Court in Coweta County since that was the county the parties address was in. Upon contacting the Magistrate Court, it became apparent owner's of Fayette Vision had skipped off with my and apparently other people's money as they could not be located.

I am now left without recourse as I the McNamee's cannot be located.
