Unfortunately, we signed a contract with Condev Homes after they helped us secure a pre-approval letter for us from FBC Mortgage. We never met their senior mortgage lender, John Edmead, only speaking with him over the telephone or while we were with the/our Condev realtor, Erik Stennes.
We were completely honest with all the above mentioned parties regarding our previous bankruptcy and foreclosure due to my husband's military, service-connected injury and subsequent disability. John Edmead denied knowing about said foreclosure, although in November of 2010, we told him our situation (along with Erik Stennes) when we first walked into the Condev model home. John Edmead wanted to do a VA loan initially, and we told him we could not because we lost it in the bankruptcy/foreclosure. He said they would provide us with a FHA loan.
After the pre-approval letter was issued in December of 2010, we gave Condev a personal check for $35,000 as a down payment on our home, which they promptly cashed. Condev began building the semi-custom home for us. We gave the money as a down payment on our home. Additionally, we gave them a check for $5,000 after we received our income tax refund. According to the contract, the funds were to be held in escrow. We were scheduled to close on May 27th or May 28th.
Approximately 3 weeks ago, FBC called to tell us they would not be doing our loan. Since then, we have made dozens of phone calls and text messages and emails to all the parties involved: FBC, the owners of Condev Homes, Andrew and Peter Gardner and Erik Stennes. We have not received our $40,000 back, nor can we get any commitment whatsover from anyone at Condev about returning our money. We have met with an attorney, who reviewed the contract and told us we should have never signed it. The Gardners continue to evade us, we fear that our money will never be seen again by us. My husband is 100% and permanently disabled and on VA disability for life. He has lost his job at Microsoft after 11 years due to a failed back surgery. We gave Condev Homes every last dime of our savings and we are devastated and lost. We need help! Please.

All parties involved in this matter have worked together to
resolve the situation. We have worked out and signed an agreement stating that monies will be returned to us
when the home is sold and closed on. The matter has been resolved. All parties are satisfied.
