My mom and dads reverse mortgage, they passed away now they just want to barge in a sell their home, it hasn't gone through probate yet, they misrepresented material facts, my parents were duressed into getting involved with the contract i want to have this contract rescinded because my parents were both declared terminally ill by their attending physicians back in may,of 2006. Back in May 2006, my mom and dad took out a reverse mortgage with financial freedom d.b.a. One West Bank and Indy Mac Bank.  They were poor people who were tricked into signing up for a HECM loan or reverse mortgage. They were both ill and didn't understand what they were getting into. The HUD counselor sold them or tricked them into it by saying that they would receive a lot of money every month for the rest of their lives.  They were told that would never have to pay it back after they passed away and that it wouldn't affect their surviving heirs inheriting the home.  Now that they both passed away, i keep getting certified mail from this Harmon Law Offices, P.C. they send one letter saying they would give me 30 days to dispute it and they would cease to try and collect of this loan. Two days later i got another cerfified letter but this one says that they are going to come right on over and force a power of sale or auction on my moms property on September 19th 2014 @ 9:00am. This is downright outrageous.  I have sent letters back to them and asking them to cease and decease all foreclosure attempts and that is trespassing. I am very scared that I am going to be thrown out of my parents' house and end up homeless.  I have a little dog and he is scared too. My parents were talked into an unenforceable sham contract.  My dad was ill with diabetes, neuropathy, and a bone infection.  There were times when he did lose touch with reality. My mom had stage one heart failure. This contract must be declared null and void based on my parents lack of capacity. How do I file a lawsuit against them? They committed fraud. And they cannot trespass on my property.  I have sent them cease and desist letters certified them, and i demanded that they cancel any power of sale on my mom and dads property.  Please help stop them from doing this, it is making me sick, i broke out in hives and i had to go to the doctors for treatment.  Plus i am living in fear everyday since July 30, 2014.
