I ordered an electric train from Fingerhut for Christmas 1997. I received the train but it wasn't anything like the one pictured in the catalog. I sent the train back with a Return Receipt for Merchandise.
The original train was $89.00. I have a signed return for Merchandise receipt which shows that the merchandise was received back by Fingerhut on 1/15/1998.This was well within the 30 day return limit since the original shipment was received on 12/28/1997. 3 days after Christmas.

I got my first collection agency notice in December 1999. At that time they claimed I owed 147.34 for the Train set that I returned. I wrote to the collection agency explaining that the merchandise was returned and provided them with a copy of the return receipt for merchandise. I figured that would take care of the problem. WRONG!!!!

Every year or so I get a new collection letter from a different collection agency. So far there have been 5 different collection companies. The Northland Group and RJM Acquistions Law Offices Of Mitchell N. Kay RJM Acquistions were the latest to contact me. This account has resulted in 5 different reports on my credit reports each for a different amount. The latest amount was $398.78. If anyone starts a class action suit against these people please let me know I will join in gladly.

How Fingerhut Returns Work or Don't... Actually

When you return something to Fingerhut, you are supposed to have a label on the order summary document that has the correct return address pre-printed on it that you affix to the outside of the box. Then you have another part that you fill out and put inside the box. On this sheet of paper, you have to check why you're returning it and whether you want refund or exchange.

You're also supposed to call Customer Service, who I worked for, and get a return authorization number so they know it's being returned. What probably happened in your instance or why the train didn't look like the one in the catalog is because they probably substituted it with another one similar to the one you ordered.

A lot of times, especially around Christmas, mail order companies will run out of specific items and instead of putting you on a backorder list, they send you a substitute. Fingerhut did this a lot. The reason that your train may have never been credited back to your account is because right after Christmas, they have so many packages coming in that sometimes they miss some and make mistakes.

If you call their customer services phone number (800-508-7800 if I remember correctly), and ask to speak to a returns specialist, they should be able to assist you in getting the problem taken care of.

Unfortunately, with Fingerhut, you have to start at the root of the problem or they'll keep handing your acct. over to different collection agencies. Hope this helps!

Dispute with the CRA's is important too

Dispute this with the credit reporting agencies. If you have been denied credit because of the three CRA'a file a dispute with them. If you have a copy that you sent this back and was credited for the return send the CRA's copies to be placed with your letter that the other person told you to put in your files. Check on your files to make sure everything is there, and recheck. Some of these collection agencies will fraudently obtain a hard copy of your credit file if this happens, dispute it and notify the FTC. Some of these Ca's are really rotten and will do anything to make you look bad to try to make you pay for something you do not owe or is time barred. Check and recheck because you can sue them if they illegaly obtain a hard copy of your files without your permission. Send a D and C letter to these people and don't communicate with them by phone. Northland Group is very slick also.

What happened here was that Fingerhut didn't credit your account with them for the returned train. They then sold the account to these collection agencies.

I think that the first thing I would do is send a letter to the Fingerhut, corporation and address it to Billing Departments or Accounts Department.

Explain the problem. Make copies of return reciept and then explain what happened. At least that way you have the report at their company. Send it registered reciept, signature required. Make copies of this letter and its reciepts and send them to the following place with signature required.

1. Current bill collectors
2. To each of the credit bureas. Have them insert it into the file. If they have established that it is an accounting error and items were returned, then the credit bureau will remove item from from your credit report or attach a letter of explanation and its reciept into your file as an amendment to the derogatory comment.

As a consumer you have a right to add notes and notations with proof to any item in your file that you wish. Just follow the directions on the credit bureau report for doing so.
