I was told when I opened the account I had overdraft protection meaning if I was negative I will still able to use my debit card. I have direct deposit and I still had a few hundred dollars from the last deposit.
I made 14 different purchases from $1.07-$31.41 and still had money to cover my car note, the total from the 14 transactions were $96 and some change. I was told that the ledger balance is when my transactions were posted and the available balance was when the pending transactions have been subtracted and put on hold. When it's put on hold that means those transactions are covered regardless of what clears before or after that.
Now when I call the customer service personnal they say it was not covered because other transactions went thru. To me that means i'm double paying because im paying $34.95(overdraft fee) for a $1.07 transaction that was suppose to be covered according to the person when I opened the account. Now I have $209.82 of overdraft fees because the bank says they weren't covered.
If the amount was subtracted from my balance how is it not covered? Why should I pay for this again and it was taking out of my account after swipping my card? This bank does not know what they are talking about and contradict themselves.

Yes..I am the great "litter bug" for tossing a couple of stinky cold cheeseburgers onto the median of a ghetto LA highway. Guilty as charged. No hiding behind any curtain..I posted this info voluntarily. I am sure the gophers or maggots or ants or rats or whatever that ate the ORGANIC matter..were quite appreciative.

I guess during your 6 years, you were not aware of the legal troubles Best Buy has had with some States Attorney General; illegally using software (copyright infringement by Geek Squad) and some unsavory business practices (duplicate Best Buy website with alternative pricing higher than what was on the public Best Buy website.) When customers complained that the in-store price was higher than advertised on the public website, the associate would go online (actually an IN-HOUSE intranet site) to a different website to show the customer that he or she was mistaken! Real ethical stuff!!!

Well lets break this down and see it if holds and weight.
As far as myself, I will not say that the OP was 100% right, so there is the first misleading statement from Robert.
I also will not say the bank is evil, but some of their tactics are evil, and deceptive. I will not fill anyone's head with "thoughts" of various lawsuits. These lawsuits are NOT thoughts, they are currently in process, another misleading statement by Robert. AND, that it is not a "thought" that banks are changing policies, because many have (I got 2 emails already from 2 different banks I use and a few credit cards as well), and there are law changes going into effect by July/August of THIS year that are forcing the banks to change some policies regarding overdrafting. Chase bank no longer will re-sequence debut card transactions in order to maximize fees in the event of an overdraft and we expect more banks will follow suit. Many banks may have to pay a settlement for doing this in the past.
The reason "they" won't tell you that past lawsuits that were settled resulted in each plaintiff receiving enough for 2 overdrafts, is because the current lawsuit is not over,as a matter of FACT, it has not even went to trial yet. During the dismissal stage however, all the banks defenses were not able to have the lawsuit or parts of the suit dismissed. Robert seemed to FAIL to mention that...hmmm..
This is not to say what the plaintiffs will get back, part all or any, but at the very least it has exposed what the banks have been doing, exposed that some of the tactics were WRONG, and force change. Some banks are already doing this voluntarily, a wise decision.
And I will also tell you, again the opposite of what Robert is implying "they" will tell you, is that you SHOULD properly manage your account properly and responsibly. However, that does not mean you will NEVER overdraft. People do make mistakes, check clearing times can be excessive, unauthorized charges can cause an inadvertent overdraft if the customer does not know about it, as well as merchant holds. Until there are laws in place that prevent any merchant or machine from applying a hold without the customers consent and permission, this is one of several ways a customer can incur an overdraft even though they keep a PERFECT register and account records.
What will help, is when the new laws are in effect and ALL banks and financial institutions must not automatically enroll every customer into overdraft protection. The banks have and will continue to make it seem overdraft protection on your debit card is a good thing and is some kind of "courtesy" they extend out of the goodness of their hearts (if a short term loan at triple and quadruple digit percentage is considered courteous considering many customers did not even sign up for it). To wit by the report here as evidence, the only thing it helped, was the bank to pocket a boatload of the customers money. As well, when ALL banks stop the unnecessary strategy of re-sequencing the order and times of our debit card transactions, even if the customer is enrolled into standard overdraft protection, and fully understands the implications, the change will only allow the bank to apply overdraft fees to LEGITIMATE overdrafts, not to transactions that had the funds available at the time of the transaction.
Is that too difficult for anyone to understand?
I do not "ignore" what these bank defenders say. It is a given that all customers should be careful not to overdraft the account. The only difference in "opinion" between us, is I feel the banks should change some policies as well, and they are. I feel the banks have used deceptions by not disclosing facts about OD protection as it applies to debit card use, and deceptively enrolling customers into this "service"
Now since the OP in this case stated they had overdraft protection and was fully aware the debit card could be used with a negative balance, how can I in all reason say this customer was not at fault in any way? I have not said that, or implied that. It is in the bank defenders minds that they think this. It is not based on any factual statements posted here.
Stop making assumptions Robert. And stop being presumptuous regarding customers that fell for some bank strategies of causing excessive fees when it might have been a human error or misunderstanding, and not just being irresponsible. And most of all, stop being such a provoker of relentless, redundant arguments.
If you, Robert, are only going to state your ONE biased side, and then provoke others who may have some opposing views by stating "they" will only state one side, which "they" have not, then perhaps it would not be so EASY to discredit you.
MY best advice for this customer, is ALSO to be careful with the account so they do not overdraft. And it might not be a bad idea to opt out of OD protection altogether. This way no matter what if the account will be put into negative, and the card can not cover it with the account balance, it will be declined at a point of sale or ATM if the AVAILABLE balance will not suffice, hence NO overdraft is POSSIBLE in this case, and NO overdraft fee will be applied. You will simply have to pay by other means or go without. Then you have opportunity figure out why the card was declined and fix the issue without being fleeced into the poorhouse by the bank.
Makes sense to me for many customers. And those that are so perfect they believe they can never overdraft under any possible circumstance can either opt into the service if they like, even though they apparently do not even need it, because they seem to believe that the ONLY way to never overdraft, is to keep an accurate register. It is a wise thing to do agreed, but to use additional defenses by not opting in to begin with, and the banks changing some unnecessary policies, THEN you will see a dramatic decrease in overdraft fee related complaints. Actually I have noticed a decrease already since last year, and I notice not a single complaint regarding overdraft fees by those banks and credit unions that did not use similar deceptions and lack of disclosure.

I am not sure exactly you "think" it works. Because it sounds like it worked exactly as they said it would. If you don't have the money available in your account for the transaction(s) you can still use your debit card. As a result you will be assessed an overdraft fee for each transaction.
When you use your debit card when it is approved they will "hold" the money(pending). It is not actually posted until the merchant submits the final authorization. This can be anywhere from 1-3 days. However, once a transaction is approved, they can no longer decline it.
Now you will probably have some people post that you are still 100% right and the bank is "evil". They may even come up with excuses as to why the bank is still at fault even though they told you that you had this on your account. They will probably fill your head with thoughts of various class action lawsuits, and how the banks are changing their policies. What they won't tell you is that the handfull of lawsuits that went anywhere, got each person enough for about 2 overdrafts. They also won't tell you that no matter what regulations are put into place. Nothing can keep you from overdrafting your account if you do not do proper account management.
This means using a register to write down every transaction when you make it. To never even attempt to spend more money than you have available in the account at the time you attempt to spend it. Also, to understand your banks funds availability policy. Doing these three very basic items will almost guarantee that you will not overdraft your account.
Now, these same people will use terms such as "bank defender" to try and cancel out what is said. Unfortunatly since they are telling you EXACTLY what you want to hear you will ignore everything else that was said. But in the end it is up to you to decide which one will actually save you from overdrafting.
