My father-in-law passed away in 1998.his sister and brother-in-law,had power of attorney over him and after his death we found out they had ripped him off.
they had stolen over 100,000, we have just settled with my husbands uncle for very little because we couldnt get the bank records from first union bank they left tenn and we tried to get the records but they don't seem to have any. all the records have conviently dissapeared.
I always thought all banks had to keep accurate records.
they had let his aunt transfer 50,000 into her own acct when he was in the hosp.we have no records of anything.this bank where ever it is needs to be closed down for good

Union Bank closed my deceased husband's solo account after allowing several to sign checks made out to each other and use his ATM after his death-then closing out the account asap though I was urgent with them to keep it open due to financial exploitation of my disabled husband.
They have refused my lawyer's letter of demand to allow me access to that account. I have got to see where all our marital joint money went to-or to whom it went to so I can prosecute the thieves.
I have a reputable bank manager that I do business with and she advised a complaint to the BBB and the FDIC along with a fax to the CEO of Union Bank-I am doing those three right now.

Were I you, I would further pursue obtaining the bank records. All banks are required by federal law to keep 7 years worth of records. For example, if you were to call the bank today, they would be able to provide you documentation all of the way back to September of 1996. You may run into a little difficulty in figuring out where your information is warehoused if the branch where your father did his banking was sold when First Union moved out of the TN area, however, they should be able to tell you which bank you can go through to obtain your father's statments. You can also call the FDIC as they keep records of all mergers and divestitures. Due to his demise, it will be necessary for the executor or holder of the letter of testementary to formally make the request. For security, they will require that you provide the original documents that awarded those powers. Please be forwarned that all banks charge fees to issue out replacement statements. If you are needing to obtain a substantial amount of statements I would recommend that you consider having the information subpoenaed as your statements will be provided at a discounted rate, however, when you factor in the cost of an attorney providing this service you may fair better it ordering them yourself.
