Introduction:

Fitzgerald Coaching, Inc states it provides appointment setting to agents called "partners." They call on behalf of agents to set appointments nationwide.  Agent buy in at $5000, 7500, or 10000 plus % of commission.  Agent also provides and pays for a list of numbers in our market area to call from.  These numbers are provided by 3rd party service, Landvoice.com.  

 When I signed the contract on May 3rd 2017, we were unaware the business was dissolved (see NY State Records online, or I can provide), we continued with them for 1 year 1 month.  But before then for 7 months tried to get a refund, waited 5 more months, tried to get a refund etc.  I tried and documented numerous times to have them resolve the issue. I emailed Bob and Megan Miller these facts below and begged them to show me where I was wrong.  No response.   I did a formal complaint to NY BBB, and NY Licensing Division, Attorney General's Office, Dept of Consumer Protection & Fraud, District Attorney's office in Monroe County.  I informed Keller Williams Realty Corporate Legal Department who are reviewing, and Im in process of interviewing attorneys and providing information to them.  Since Robert or "Bob" Fitzgerald or Megan will not contact me to resolve this matter and contest these very facts I have below, then maybe any of the Realtors or Employees that feel the same way as I do will contact me to verify there experience.  David 832-857-6868, info@investorgroupkw.com

My view of the business model (bait & switch possible ponzi scheme):

 My view of the Bait:

Contract I signed below states in special terms:

1.  I was to provide a call list "list updates," (which I have evidence of that, and is not disputed)

      a. I would pay for landvoice.com, a 3rd party that supplies all the list and phone numbers

2.  I was to communicate after every listing appointment

3.  I was to be given 1-2 appointments per week

4.  I was to give in return $5000 (pif), and a % of commission at closing (see contract below)

 After agreement signed:

1.  We started receiving emails of new terms (The Switch).  We were now supposed to contacts/leads they send us. 

2.  We received 2 contacts/leads apprx month 5, and were instructed by Fitzgerald Coaching, Inc team that we need to call them for us to set appointments (new terms not in contract)

3.  We did call on them and try to set our own appointments, but most of the leads never heard of the prospector or me and hung up.  There were ONLY 7 leads, and no appointments in a 1 year period as of date.  We were promised 1-2 appointments a week that are set by Fitzgerald Coaching, Inc prospector not us. (see contract)

4.  We requested a refund around our 6 month mark

 My view of the Switch:

Then Megan Miller (office manager I believe) said we were to communicate on every lead they gave us not just appointments (new terms), so no refund.  She stated we must abide by the new terms (contract states no modifications).  She then stated that Fitzgerald Coaching, Inc would sue us if we complained about it online or otherwise.  I have the email of this.  I then looked them up online and realized there are many complaints about them.

 My view of Misrepresentation:

1.  Bryan Teed the sales rep called me stating that Fitzgerald Coaching, Inc. was an approved vendor with Keller Williams Realty, and many other large name brand Realty companies.  He stated that they set appointments for thousands of agents nationwide.  I found out later that this statement "approved vendor for Keller Williams Realty" is not true and a misrepresentation that I bought into and was the deciding factor to agree to terms. (my testimony can be corroborated by other victims)

2.  Bryan Teeds contact phone number has been disconnected since, but I do have his contact info from email as well if needed.

3.  According to the New York Seceratary of State, Fitzgerald Coaching, Inc. dissolved the company on June 29, 2016 making invalid the authority of any persons/members with this company to do business in this state.  I EMAILED Megan Miller & Robert Fitzgerald (coachbobfitzgerald@gmail.com) THIS VERY FACT ASKING IF THIS IS TRUE, NO RESPONSE.
