New law for unemployment: Effective August 1, 2011, Section 443.101, Florida Statutes was amended to provide that severance pay is disqualifying/deductible income.  When a claimants severance pay for a particular week is equal to or greater than the claimants weekly benefit amount, the claimant is not entitled to benefits for that week.  When the remuneration is less than the benefits which would otherwise be due, the claimant is entitled to receive reemployment assistance benefits reduced by the amount of such remuneration. 

Severance pay is compensation for the loss of a job.  It may be paid on the basis of length of service for an employer.  It is a matter of agreement between an employer and an employee.  Severance pay provided to an individual regardless of the reason will affect a claimants eligibility for benefits. 

I was never told by Florida Unemployment or anyone by signing a release letter would disqualify you for your unemployment benefits in Florida. Now it does. Also, I submitted a claim on 6/12 and did everything correctly and took them till 7/30 to make a decision. I was never called and was sent e-mails only and no direct numbers to call back to.

If you do get fired or let go from a employer without notice please beware of signing a release or severance letter you will be denied benefits in the State of Florida
