Attention Franklin Services:

 I am no longer interested in your services due to the judgment I received from both your services and the attorney you had to represent me.
Franklin Services represented me (writing correspondences) for pay day loans and actually signed my signature when sending mail to the pay day lender.
 
I now have a copy of one letter that you faxed to one lender! However, whatever argument you sent to the pay day lender was not forwarded to the Attorney that represented me, therefore leaving him with nothing to debate about. Some of these lenders were in default of your timely four to five months of services that Franklin Service rendered by not responding in a timely manner.
 
In addition, I only had two negative items on my credit reports, which was bankruptcy that was scheduled to fall off my reports in 8 months. The sales person (bg@franklintoday.com) told a fabrication about your services and how you handle the lenders if they made a report to the credit bureaus. The last time I counted, you have 19
complaints and growing that is registered against Franklin Services LLC. 
 
Therefore, I am requesting a full refund of all my funds paid to you. Furthermore, your company will cease and desist from taking money out of my account
that I have registered with Franklin Services.

Franklin Service LLC Exposed, Job Well Done!

The War against Franklin Services LLC (FS) was won before the Battle was fought! It is not about the money it is about exposing the Fraud and Misrepresentation of this company that they commit against all consumers, myself included. I am fighting the good battle by exposing these corporate thieves taking money from people with an inexcusable outcome placing the consumer in a worst situation than they started.  

Franklin Service Program is not foolproof. This is why there were 19 complaints against (FS) and why they refund money to dissatisfied customers.When I wrote the email to FS requesting the refund on March 26, 2015; I sent several contact emails of(FS) to (FS) with Ripoff Reports included in their email. I could have reported to Ripoff Reports after I receive the money from (FS). 

Franklin Services made the comment that I made a barrage attack on them by contacting government entities. My initial contact was with two entities;the Attorney General, Pam Bondi of Florida and the Attorney General Herbert H. Slatery III of Tennessee. The Attorney General Pam Bondi forward my emails to the government entities listed below:

Furthermore, these government entities are not Attorneys and cannot enforce or force a company by law to do anything against their will. These government agencies did not reject any complaint I proposed to them. That is not how they operate and it is not in their lingo to usewords such as "reject"because I spoke with and to them at length. I was told that they receive a complaint from the consumer and then forward it to the Business for a response and if the proposal or complaint is not accepted by those two parties, they close the case. Who in there right mind will continue to argue back and forthwith Franklin Services LLC knowing that the consumer is not going to recant his story (the Truth)and Franklins Services is going to continue to fabricate their story (a Deceitful Intent): this is counterproductive. The Payday Loan Validation that Franklins Services attempt to do is Counterproductive.The War is Won by Exposing these Corporate Thieves and having them explain themselves is an uphill battle for Franklin Services LLC. 

Regarding my credit reports; my credit was not horrible... it was average with scores in the median range consisting of 690, 650 and 645 respectively, before I hired Franklin Services LLC April 2014.

In response to the complaint by the consumer, you should be advised that a majority of the facts have not been disclosed to you by the consumer.  We have a one hundred percent satisfaction policy with our clients and when this client advised us that he was unhappy, we immediately agreed to issue him a refund.  He provided us credit card information and when our electronic system attempted to issue a refund to the cards he provided to us, we found out that the refunds did not go through due to the apparent fact that his credit cards appear to have been cancelled.  We actually feel fortunate that this happened because after we agreed to the refund and resolved this matter, the client then went and made slanderous comments about us on the rip off report, the better business bureau and has undertaken a campaign of slander against us.

 As a result, we have been forced to undertake the engagement of legal counsel and expend large amounts of monies to try to repair the damage this client has created.  Hence, after we resolved this matter, the client assumed that she had received the refund and then violated our settlement by making slanderous comments.  We believe that we now have legal claims against this client and are evaluating all of our legal options.  Although we have never ceased a refund on a client before, we believe that this situation merits special action on our part due to the extremely aggressive and false accusations the client has made.

Quite frankly, the fact that the client has now complained to you and continues to barrage us on the internet, continues to call and use profanity and continues to threaten us leads us to believe that we may need to go to court to have a restraining order issued against this person. 

We stand behind all of our work, have never stopped a refund before and also note that the client has never seen her entire file and yet claims we did no work.  Rather it appears that the client has received our services, has requested a refund because of our policy of easily giving refunds and is trying to steal services from us and now is acting unprofessionally against us after we have decided to retain a lawyer and review all of our options.  We sincerely hope that you will recognize that this client is not acting in a reasonable manner and should not use the threats of government action and slander as a means to take our services for free.  Thank you.

 Please accept this as a response to the above referenced complaint.  At  the outset you should be advised that this client has complained to multiple agencies and continues to make complaints and each and every agency has rejected his claims.  Therefore, it is not surprising that the client above has now complained to you as he simply appears to be following the tact of simply complaining to every possible agency until he hopes that someone will accept his position.  I am certain that you will reject his claim just as everyone else has done.

We supplied exhibits with the most recent rejections of this client's claims from both the Better Business Bureau and Florida Agencies.  As you can see this client keeps recycling the same claim.

 To give you background, this client hired this company and not only did this company perform all services, this company actually hired a lawyer and paid all attorneys fees for the client who then lost in court and was ordered to pay monies.  Furthermore, the client claims that his credit report was somehow affected by this company even though the client had horrible credit and multiple marks on his credit well prior to hiring this firm and all of our documents clearly stated that we do no credit repair services whatsoever.

               We did extensive work and provided everything promised. 

               We respectfully request that you also reject his claim as done by all others.  Thank you.

Dates Provide Proof Franklin Services Fallaciousness Inaccuracies Telling The Truth

On or about March 29, 2014 I contacted Franklin Services LLC via telephone from a Television Commercial regarding validation of payday loans. My first contact was with Ms. Brody Greenberg (Account Supervisor) who assured me that Franklin Services LLC (FS) is a Validation Company that deals with Payday Lenders. She stated that FS help clients by validating their current Payday Loans to make sure they are valid and that the Lenders are licensed in their state and are following state laws. She furthermore stated that; what consumers like myself do not know is that the majority of Payday Lenders are illegal. I inquired about the payday lenders reporting me to the Credit Bureaus during their validation process and she assured me that if they do, that the clients have unlimited legal representation during the entire process and this is something that the competitors cannot match. After our phone conversation Ms. Greenberg guaranteed the unlimited legal representation in writing without additional charges. See attached document from Ms. Brody Greenberg dated March 29, 2014.
After the telephone conversation and receipt of her first letter via email; I received instructions to complete the electronic signature of their Debt Resolution Contract to employ. I signed and gave them my debit card information for the fees to complete the contract and all this transpired on March 29, 2014.
 
Other activities that took place on this same day sent to me via email; was the Instructions for the FDIC Letter to my banking institution; a Welcome Letter via email stating; ( "…Please understand the process of Validating your Debts does not happen overnight and it is very important you stay current with your payments to us so we can continually correspond with your creditors and stay on top of your Program. The only way your Legal Representation, which is included in your program, with the additional level of protection stays in effect is if you STAY CURRENT WITH ALL YOUR PAYMENTS to the program..."): another email stating, We Are Missing Information For Your Documents which was to provide all the creditors and their contact information.
 
This contract was understood to be a four month validation program/process and the payday lenders will not contact the client after the first four weeks. It was also stated that if the payday lenders did not respond in this time frame the debt was understood to be null and void with no more contact from the payday lenders.
I honored my part of the obligation of this contract by keeping all my payments current, providing FS with the contact information of the payday lenders but when the payday lenders reported me to the Credit Bureaus there was no Legal Recourse provided by FS. FS provided instructions for me via email of how to personally dispute the items they validated (the payday lenders). I would have never signed up with FS if I knew I had to personally dispute these payday lenders that were validated illegal. There were only two negative items on my credit reports before I signed a contract with FS and those items were Bankruptcy which was filed in 2006 and discharged in 2007.
I have included all email contact with FS from March 29, 2014 through October 10, 2014. In addition, an email stipulating I have went Debt Validation Progam through Franklin Services LLC and the email is to confirm that I have completed my obligations as provided in the contract.
Franklin Services validation process potentially ended in the end of August 2014 and then I was surprised about their pre-paid legal services in September 2014 at $39.99 in the event the payday lender contacted me again or attempted to sue me. What is with wrong with this validation process that was a failure? Therefore, I was persuaded to continue and by the end of December 2014 I could terminate this additional money they did not mention in the beginning of the contract that I would have to pay.
 
Well guess what, I got sued and served with a summon on December 12, 2014. Franklin Services did provide me with an attorney but did not provide the attorney with documentation of the process they went through to validate the payday lenders were illegal and letters were sent to the creditor. So what did the attorney have to argue/debate with against the debtor if FS did all this work they claimed to have done? I spoke with the Attorney and decided with him that I will agree to make payments of $50.00 a month on a debt of $814.32 that I could have paid off by now. The attorney said he would ask for a continuance and would get back to me regarding the payday lender agreement and I need not to show up on the original court date January 26, 2015. The attorney never called me back!
 
Nevertheless, on or about February 4, 2015 I received a letter from Mark D. Emonds, Attorney at Law representing the payday lender that there was an judgment entered against me and now I am making monthly payments to the Washington County Courthouse, Tennessee via this payday lender with whom; I had never had a late payment with until I met Franklin Services.
I contacted Franklins Services about this matter and they had personal injury attorneys calling me at all times of evening and night from: (561) 948-4491: (561) 413-9653, etc., which was a joke and a insult to my intelligence.
Therefore, I am requesting Franklin Services to vindicate me the client by issuing a Full Refund; my credit report cleared from the flawed and insignificant research that Franklin Services completed and validated that the loans were payday loans; The judgment that was rendered against me from a payday lender paid and the other payday lenders that they validated, paid.
Franklin Services should be made to pay or negotiate payment with the payday lenders that they validated through their flawed and insignificant research; their misrepresentation that they would accommodate me with an attorney throughout the whole process. This misrepresentation is what lured me into the contract and then they baited me and then switch by saying the attorneys are not available until the end of the four month validation. These payday lenders that now appears on my credit reports as negative items has reduce my credit score tremendously by 100 points or more. These are a few of the damages that I have incurred through Franklin Services LLC services rendered.
 
False Advertising
"Any advertising or promotion that misrepresents the nature, characteristics, qualities or geographic origin of goods, services or commercial activities" (Lanham Act, 15 U.S.C.A. § 1125(a)).
Proof Requirement
To establish that an advertisement is false, a plaintiff must prove five things:
(1) a false statement of fact has been made about the advertiser's own or another person's goods, services, or commercial activity; The Letter from the Supervisor stating I would have access to an attorney throughout the entire process, The Validation that the Payday Lenders are in fact Payday Lenders and they have 30 dayst to respond or they are in default.

(4) the advertising involves goods or services in interstate commerce (location and business is conducted within the 50 states in the United States of America; and
(5) the deception has either resulted in or is likely to result in injury to the plaintiff. The most heavilyweighed factor is the advertisement's potential to injure a customer. The injury is usually attributedto money the consumer lost through a purchase that would not have been made had the advertisement not been misleading. False statements can be defined in two ways: those that are false on their face and those that are implicitly false.
Again the letter that lured me into the contract regarding attorney representation throughout the entire process, my credit reports are damaged, I now have a judgment rendered against me from one of the payday lenders, etc.
 
Damages
To collect damages, the plaintiff generally has to show either that some consumers were actually deceived or that the defendant used the false advertising in bad faith.
Four types of damages are awarded for false advertising: profits the plaintiff loses when sales are diverted to the false advertiser; profits lost by the plaintiff on sales made at prices reduced as a demonstrated result of the false advertising; the cost of any advertising that actually and reasonably to the responds to the defendant's offending advertisements; and quantifiable harm to the plaintiff's good will to the extent that complete and corrective advertising has not repaired that harm

To Whom Concern: My Fees were paid on or about March 29, 2014 to commence the program with Franklin Services April 1, 2014. My Fees paid on April 3, 2014 - $148.00. May 5, 2014 - First payment $215.25. June 5, 2014 - Second payment $145.25. *This payment and future payments were reduce because Security Finance was not a pay day lender. *Therefore, I requested a refund in which you deducted from this June payment and future payments in the four month process. *I sent you the 13 emails confirming this email prior to this one... July 5, 2014 - Third payment $180.25. August 5, 2014 - Fourth payment $180.25. September 2014 to March 2015 is 7 payments at $39.99 which equals $279.93. Total Refund Should Be $1,148.93. 4. 3 Emailed Verification of Debt Letters to your Creditors listed on Exhibit B

As you know, some debt collectors do not follow the rules of the FDCPA and that can be used to your advantage if they continue to harass you. We are not lawyers but at this point you can consult with one to discuss the collection harassment you are being subjected to.
After discussing with our management of your complaint, however, we will let you know that we do strive for 100% customer satisfaction and with the 10,000+ clients we had we have a very low complaint ratio. We are sorry you had a poor experience, your refund will be all of your fees less any amounts we paid on your behalf. 471 + all 39.99 =239.94 + 471 = $710.94

I check my account a few minutes ago and found there was only one deposit
refunded back to my account totaling $39.99 of the $710.94 to be refunded.
If you could please clarify for me; that the remaining eight of the nine
transaction receipts Franklin Services LLC sent to me via email will be

On or about April 14, 2015 FS response to the complaint with BBB : The response we gave to client was posted by client and that is our position with regards to this matter. Please look at clients posting of our emails in regards to this matter.
 
On or about April 15, 2015 I the Consumer did not accept FS response and wrote this:

Franklin Services is not Accredited with the Better Business Bureau (BBB) and there are 19 plus complaints filed against this company on there (BBB) Website: http://www.bbb.org/south-east-florida/business-reviews/financial-planning-consultants/franklin-services-in-boca-raton-fl-90070456. I have never negotiated with Franklin Services LLC! The company just dictated to me what I was going to receive and reneged once they found out I made their deceptive practices public. If you read the above detailed information carefully, you will see that Franklin Services LLC are reputable liars and good at these ("gift of gab and very argumentative, threatening and use intimidation on their own clients") deceptive practices via emails. They never use the United States Postal Services; just the telephone, fax and emails. Why are they so secretive? They promise legal recourse throughout the whole entire process and I have documentation to prove it from a Supervisor. There advertising was false and misleading about some aspect of the product, in which was an important factor in my decision to go forth and purchase their product. Franklin Services LLC stipulated: "Franklin Services is a Validation company that deals with Payday Lenders. We help our Client by Validating their current Payday Loans to make sure they are valid and that the Lenders are licensed in their state and following state laws. What Consumers like your self do not know is that the majority of Payday Lenders are illegal. Franklin Services has been assisting Consumers get from underneath illegal loans for over 3 years with zero complaints. All Clients have unlimited legal representation during the entire process something the competitors cannot match." They claimed no complaints in over 3 years and on the BBB Website they had a complaint 09/02/2013; 11/18/2013; 12/09/2013... and my first contact was 03/29/2014. This is definitely within that 3 year period they confess "...3 years with zero complaints..." They baited and switched by luring me with and email from the Account Supervisor with an unbeatable deal that is no longer available through the entire process but at the end of the process, very misleading. 

The payday lenders reported me to the 3 credit bureaus and Franklin Services provided no lawyer but instructions on how to contest negative items on my credit reports. They made more work for me than I was doing before meeting them. I only had two negative items on my credit report and that was bankruptcy that will fall off in year 2016. After dealing with Franklin Services, I had a total of 6 negative items that reduced my credit scores significantly. This is a Fraudulent Business Advertisement subjugated on a 100 Per Cent Disabled Veteran with 18 surgeries. My medical records was faxed to this company in the beginning and they added them to to my personal records they have on file. Therefore, Franklin Services were aware of my disabilities and limited income for this debt validation for payday lenders. Payday lenders are still contacting me that Franklin services validated. Payday lenders reported me to the three credit bureaus with no recourse or lawyer offered. Franklin Services Stipulated to defend me from the payday lenders reporting negative information. and I have a current judgment entered against me because of Franklin Services LLC service rendered. The remaining four payday lenders are still contacting me more than a year after Franklin Services stated they will not contact you after the first four weeks of rendered services by their company.
 
 
 
This is Franklin Services LLC latest response from BBB Claim I submitted.
They continue to insult me by call me a "SHE"
I will respond when I receive my information from my Credit Union disclosing
how FS is telling an outrageous untruth about my credit card and me calling them.
I just cancelled my credit card on Monday, April 20, 2015 because I thought they would 
continually take money from my account. 
 
Regarding calling them; I am sure they record conversations for quality assurance purposes when I 
supposedly called them and curse them out... after requesting a refund.
This one of the many reasons why I   did not talk to them   over the phone when I requested a refund.

We have a one hundred percent satisfaction policy with our clients and when this client advised us that she was unhappy, we immediately agreed to issue her a refund. She provided us credit card information and when our electronic system attempted to issue a refund to the cards she provided to us, we found out that the refunds did not go through due to the apparent fact that her credit cards appear to have been cancelled. We actually feel fortunate that this happened because after we agreed to the refund and resolved this matter, the client then went and made slanderous comments about us on the rip off report, the state of Florida and has undertaken a campaign of slander against us.

As a result, we have been forced to undertake the engagement of legal counsel and expend large amounts of monies to try to repair the damage this client has created. Hence, after we resolved this matter, the client assumed that she had received the refund and then violated our settlement by making slanderous comments. We believe that we now have legal claims against this client and are evaluating all of our legal options. Although we have never ceased a refund on a client before, we believe that this situation merits special action on our part due to the extremely aggressive and false accusations the client has made.

Quite frankly, the fact that the client has now complained to you and continues to barrage us on the internet, continues to call and use profanity and continues to threaten us leads us to believe that we may need to go to court to have a restraining order issued against this person. 

We stand behind all of our work, have never stopped a refund before and also note that the client has never seen her entire file and yet claims we did no work. Rather it appears that the client has received our services, has requested a refund because of our policy of easily giving refunds and is trying to steal services from us and now is acting unprofessionally against us after we have decided to retain a lawyer and review all of our options. We sincerely hope that you will recognize that this client is not acting in a reasonable manner and should not use the threats of government action and slander as a means to take our services for free. Thank you

Franklin Services Made Public & Renege On Agreement, Reputable Liars

March 30, 2015, I received a reply to my first post on Ripoff Report from Franklin Services, Donald Smith in the Legal Department.

"We are in receipt of your email, although we disagree with the contents, we are a reputable company and always want our clients pleased with us. Therefore, we are issuing you a refund as requested. We are sorry you had a poor experience, your refund will be all of your fees less any amounts we paid on your behalf. Thank you."

March 30, 2015 sent 9 Franklin Services LLC Transaction Receipts stating the dollar amount to be refunded, card refund, and that the transaction was a success commencing at Date/Time: 03/30/2015 4:25:13 pm EDT and ending Date/Time: 03/30/2015 4:38:00 pm EDT totaling $710.94 and I paid them $1,148.93.

March 30, 2015 6:34 pm EDT I replied:

To Whom Concern:

My Fees were paid on or about March 29, 2014 to commence the program with Franklin Services April 1, 2014

My Fees paid on April 3, 2014 - $148.00

May 5, 2014 - First payment $215.25

June 5, 2014 - Second payment $145.25

*This payment and future payments were reduce because Security Finance was not a pay day lender.

*Therefore, I requested a refund in which you deducted from this June payment and future payments in the four month process.

*I sent you the 13 emails confirming this email prior to this one...

July 5, 2014 - Third payment $180.25

August 5, 2014 - Fourth payment $180.25 September 2014 to March 2015 is 7 payments at $39.99 which equals $279.93 Total Refund Should Be $1,148.93.
